The direction is to apply a discount to get the criminal under the deport-with-greater-ease threshold if the discounted sentence is still within the range of reasonable for the crime. This has indeed been abused (I've found cases where it helped people guilty of groping, sexual harassment, trying to solicit a minor for sex, child porn, for example; it's awful) But that's beside the point. At the end of the day it's an an unfair discount, even if the court tried to make it seem fair. Sentences are shortened that otherwise wouldn't be. It shouldn't be on the table for consideration at all.

In March, a foreign worker from India (student turned permanent resident) got 5.5 months of house arrest for using her position as a Walmart cashier to help her friends steal $7000 worth of merchandise. "Immigration consequences" was one reason for the light sentence.
