I’ve said it before and I’ll say it again: the NDP's mandatory ICBC no fault policy must be immediately repealed and replaced. We need to restore the right of seriously injured victims to hold at-fault drivers accountable. Here’s my letter to the legal community on repealing no fault and restoring self-governance to the profession within year one of a Conservative government. But let me be even more clear: At the very least my reforms will restore the "minor injury cap" system which existed from 2019 to 2021, but I think BC can do better. Too many serious injuries were unfairly captured as minor and British Columbians must have the right to have their cases heard by a constitutional independent judge or jury, not an online tribunal hired and fired by government. By studying and learning from other Canadian provinces which don't have no-fault, we can legislate a car insurance system that keeps rates affordable, while ensuring that those seriously injured on British Columbian roads can recover the best damages in Canada.
