The New York Times has spoken with several Moroccan nationals who say they were encouraged to cross into Ceuta by the Moroccan authorities.

This is crazy: The Spanish Supreme Court (Contentious-Administrative Chamber, Section V) confirmed on July 8, 2026 that applying "devoluciones en caliente" (immediate pushbacks) to migrants arriving by sea is illegal, notably for those attempting to reach Sebta or Melilla by swimming. The ruling was made public on July 8, 2026, then widely circulated on July 10 by the General Council of the Judiciary (CGPJ) and the Spanish legal press. This ruling certainly encouraged the first migrants to attempt the crossing to Sebta. The maritime route to Sebta, undertaken by swimming, is dangerous because of the presence of very powerful currents. This morning, four deaths and some twenty missing were reported [the source text reads "cingtaine," most likely "vingtaine," about twenty, though possibly "cinquantaine," about fifty]. The provision of Spanish immigration law authorizing immediate pushbacks applies only when a migrant attempts to cross "physical elements of border containment." In other words, the Sebta fence, the Melilla fence, and physical barriers. The sea, by contrast, is not an element of containment. The Court specifies that drones, cameras, radars, and sensors do not substitute for a physical barrier. A migrant intercepted at sea therefore cannot be returned immediately without an individual administrative procedure. The ruling stems from an appeal brought by an Algerian national who was intercepted at sea while attempting to reach Sebta by swimming, then immediately returned to Morocco. The lower courts had already ruled in his favor. The Supreme Court now confirms this interpretation and unifies Spanish case law. Since this decision, persons arriving by sea must be identified, must undergo an individual administrative procedure, and can no longer simply be handed back across the border minutes after their arrival. medias24.com/2026/07/30/seb…
