Whenever Beijing insists “Taiwan has always been part of China,”
they always pull out the same line — “The Cairo Declaration said so.”
But here’s the real conclusion from international law scholars:
The Cairo Declaration was merely a statement of intent.
It has no legal force.
It did NOT determine Taiwan’s territorial status.
The first time Taiwan’s status was formally addressed was in the
1951 San Francisco Peace Treaty.
And even there, it only says:
“Japan renounces Taiwan.”
What it doesn’t say is:
“Japan returns Taiwan to China.”
That line doesn’t exist anywhere.
So under international law, Taiwan’s status remained undetermined.
After 1945, Chiang Kai-shek’s ROC forces entered Taiwan,
but that was legally:
“Occupation on behalf of the Allied Powers.”
Not ownership. Not sovereignty.
That’s the truth — which Beijing never mentions.
