AN OPEN LETTER TO OHIO GOVERNOR MIKE DEWINE
Dear Governor DeWine,
I am preparing coverage for my radio show and news publication on your April 16, 2026, statements to NBC4, in which you denounced a gubernatorial campaign ad as “inaccurate” and asserted that Dr. Amy Acton would not have issued the 2020 polling-closure order “without your approval,” stating explicitly: “I told her to issue the health order. The decision was mine.”
This claim directly contradicts the official record issued by your own office in March 2020 — a record that remains live on governor.ohio.gov:
The headline on the press release on your government website reads: “Ohio Department of Health Issues Order on Closure of Polling Locations.”
The lead paragraph states: “Ohio Department of Health Director Amy Acton, M.D., MPH, tonight issued an order regarding Closure of the Polling Locations…”
Your own statement that night: “Health Director Dr. Amy Acton will order the polls closed as a health emergency.”
Dr. Acton personally signed the Director’s Order, citing authority granted to her under Ohio Revised Code § 3701.13 — the same statute she invoked for mass-gathering bans, business closures, the Stay-at-Home Order, and every other restriction on Ohioans’ freedoms.
This occurred after a Franklin County Common Pleas judge declined to postpone the election.
For the record, please provide written answers to the following questions no later than 2:00 p.m. EDT today:
Why are you now claiming the Ramaswamy – McColley ad is inaccurate when your own administration’s website, your own public statement, and Dr. Acton’s signed Director’s Order all confirm that she — not you — issued the polling-closure order under R.C. 3701.13?
Isn’t it bad form to oppose members of your own party who relied on facts that you stated in 2020, published at the time and that remain in the public purview today? Did you think about the impact of your statements to NBC which may elevate Democrat Amy Acton in this gubernatorial campaign?
Why are you defending Dr. Acton’s actions in this manner when the statutory authority, the signature on the order, and the contemporaneous public record all attribute the decision to the Health Director exercising powers granted directly to her by state law?
Why didn’t you state in 2020 that you ordered Acton to sign the directive? If you did, can you provide proof? Better yet, why create a press release that’s still on your website that misstates the truth? Do you not hold the truth in high enough regard to give it to Ohioans?
If I do not receive responses by the 2:00 p.m. deadline, I will report on both the documented 2020 record and your silence.
