Il 23 marzo la Fondazione Hind Rajab (HRF) ha presentato in Italia una denuncia penale contro l'ex comandante militare israeliano Ofer Winter.
La HRF, organizzazione no profit belga che si batte contro l’impunità di Israele per i crimini di guerra e violazioni dei diritti umani, accusa Winter di crimini di guerra commessi durante l'Operazione Protective Edge del 2014 e di incitamento al genocidio a Gaza.
La denuncia giunge mentre Winter sta per recarsi in Italia la prossima settimana per partecipare a eventi pubblici.
Il documento presentato dalla HRF stabilisce una continuità tra la condotta passata e quella presente, sostenendo che “lo stesso comportamento criminale, il disprezzo per la vita dei civili e l'impostazione ideologica caratterizzano le azioni di Winter durante tutta la sua carriera militare e pubblica”.
Un elemento centrale della denuncia riguarda gli eventi del 1° agosto 2014 a Rafah, noti come "Venerdì Nero".
In seguito alla cattura di un soldato israeliano, Winter ordinò l'attivazione della Direttiva Annibale, scatenando un attacco indiscriminato e su vasta scala contro un'area civile densamente popolata.
Dal 2025, Ofer Winter ha pubblicato su Instagram numerosi video a sostegno alla distruzione di Gaza, nonché alla sua occupazione attraverso lo sgombero forzato, l'assedio e la fame della popolazione palestinese.
Alcuni esempi delle dichiarazioni di Winter: "L'obiettivo finale deve essere l'assenza di palestinesi a Gaza, “La vittoria arriverà quando non ci saranno più arabi a Gaza”.
Il ricorso della HRF afferma che le autorità italiane hanno sia la giurisdizione che l'obbligo legale di agire.
“Ofer Winter, che ha commesso crimini di guerra nel corso della sua carriera, rimane un criminale di guerra. Grazie alla sua impunità, ora incita altri a commettere genocidio” ha dichiarato Natacha Bracq, responsabile del procedimento penale presso HRF.

A kind and gentle young man who liked to dress smart, he would joke: 'You never know, maybe I'm about to meet my future wife'. He spent 1.5 years covering the genocide of his own people. His home was bombed on October 7. His hometown, Beit Hanoun, was levelled. He lost 100 of his family and friends. The jewish occupation threatened him to stop reporting. Stop exposing the massacres. He refused. They told him to move south. He stayed in the north. Stayed with his people. Steadfast. Unwavering. Hossam stayed away from his family for 15 months. Palestinian journalists do this in case they are targeted...to protect their families. He finally reunited with his family, his mother, sisters, and nieces after the ceasefire in January 2025. Millions of us across the world celebrated their embrace. Then the jewish occupation fabricated lies that he was a fighter. On 18 March, they breached the ceasefire.
