$Eth passed the decentralization test according to Hinman, Gary Gensler (no case filed) and now Trump. Now the SEC has ruled that $XRP held by retail passes that same test. Left standing is that the $XRP sold to institutions to build out Ripple violated securities statutes because they were securities issued without proper disclosure. Ripple just paid a $50 million to settle the case. Sorry those are the facts. Left up-in-the-air is the clash at the southern district over Torres's inconsistent ruling.
