We are pleased to announce that our Partner, Chinwe Ogban, has contributed an insightful article to the March/April 2026 issue of CITMA Review titled: “Protecting Your Brand in Africa: A Practical Guide to Combating Trademark Squatting.” Trademark squatting has evolved beyond a mere legal inconvenience; it has become a substantial economic challenge for established brands operating in, or seeking entry into, the African market. As Africa continues to solidify its position as a prime destination for foreign investment, increasing commercial activity has been accompanied by a corresponding rise in opportunistic trademark registrations. In the article, Chinwe provides practical, strategic guidance on how businesses can effectively address these risks, underscoring that proactive intellectual property protection is no longer optional, it is a critical business imperative. More notable points from our speakers during our Data Privacy Webinar on "Data Privacy and Regulation in a Global Digital Economy: What Trust, Ethics and Innovation Mean for Organisations Today": - Innovation requires a strong ethical foundation in which developers prioritize trust as much as technical advancement. Protecting that trust requires businesses to implement strict internal controls to prevent employees from inadvertently leaking client data into public models, while remaining mindful that many AI systems track user inputs without explicit consent. - A sustainable data ecosystem depends on a ‘triple threat’ relationship; a joint commitment between Regulators, Data processors, and Data Subjects to uncover breaches and prevent illegal data usage. - Embedding privacy meaningfully requires investing in internal accountability mechanisms, such as appointing Data Protection Officers at the board level, designating "Privacy Champions" within each business unit, and maintaining a consistent, open dialogue with regulators. Organisations are reminded that the deadline for filing data compliance audit returns is 31 March. Non-compliance may attract penalties and regulatory sanctions from the Nigeria Data Protection Commission (NDPC). NDPC Rolls out Nationwide Data Protection Investigation Across Tertiary Institutions. The Nigeria Data Protection Commission (NDPC) has commenced a sector-wide compliance investigation of tertiary institutions across Nigeria, granting affected tertiary institutions 21 days from the issuance of the notice to demonstrate compliance with the Nigeria Data Protection Act (NDPA) 2023. The sweep covers: · 65 Federal Universities · 62 State Universities · 155 Private Universities · 100 Technical Colleges · 22 State (Private) Technical Colleges · 29 Federal Colleges of Education · 50 State Colleges of Education · 71 Private Colleges of Education · 34 Federal Polytechnics · 40 State Polytechnics · 61 Private Polytechnics Tertiary institutions must provide evidence of: · Filing the NDPA Compliance Audit Returns for 2024 – Section 6(d) of the NDPA; · Designation or Appointment of a Data Protection Officer with full contact details - Section 32 of the NDPA; · A summary of technical and organisational measures for data protection within the institution - Section 39 of the NDPA; and · Registration as a Data Controller or Processor of Major Importance – Section 44 of the NDPA. Failure to comply may result in enforcement orders, administrative fines, and/or criminal prosecution in accordance with the NDPA. The Commission has also approved the establishment of a regulatory compliance clinic to support institutions in strengthening data protection practices within the education sector. Affected organisations are strongly advised to engage a licensed Data Protection Compliance Organisation (DPCO) to meet their NDPA obligations before the deadline.
