Jamaica has taken a significant step towards inclusivity with the recent amendment to the Copyright Act, prior to the country’s accession to the Marrakesh Treaty on August 28, 2024. The treaty, designed to facilitate access to published works for individuals who are blind, visually impaired, or otherwise print disabled, marks a critical advancement in addressing the long-standing issue of the “book famine” faced by these communities. During her participation in a JIS ‘Think Tank’, on August 28, Executive Director of the Jamaica Intellectual Property Office (JIPO), Lilyclaire Bellamy, highlighted the importance of this treaty. The Jamaica Intellectual Property Office (JIPO) plays a crucial role in fostering the growth and effectiveness of Collective Management Organisations (CMOs), which are vital to the protection and management of intellectual property rights for creative individuals. Deputy Director/Legal Counsel, JIPO, Shantal English, informed JIS News that the Office’s assistance includes hosting quarterly meetings with CMOs to provide updates on office activities, new laws, and regulatory changes, such as the Copyright Amendment Act 2023. “The recent amendment has been pivotal in legitimising the operations of CMOs and enhancing their capacity to serve creators effectively,” she said. Executive Director at the Jamaica Intellectual Property Office (JIPO), Lilyclaire Bellamy, is urging the public, industry stakeholders, and policymakers to enhance their support for Collective Management Organisations (CMOs). These include the Jamaica Association of Composers, Authors and Publishers (JACAP), Jamaica Copyright Licensing Agency (JAMCOPY), and the Jamaica Music Society (JAMMS). During a JIS ‘Think Tank’, held at the agency’s head office on Wednesday, October 23, Ms. Bellamy emphasised the critical role of CMOs in protecting the rights of Jamaica’s creative individuals. She acknowledged that in an increasingly global market, where tracking the dissemination of creative works is challenging for individual artistes, the importance of CMOs cannot be overstated. Copyright and Related Rights Manager at the Jamaica Intellectual Property Office (JIPO), Vivian Rose, is urging Creatives across Jamaica to improve their understanding of copyright and related rights to protect their valuable intellectual creations. During a recent Jamaica Information Service (JIS) ‘Think Tank’, he advised that while copyright protection is automatic upon the creation of a work, knowledge is the key to navigating the complexities of the law. Mr. Rose explained that when it comes to copyright, “the person with the best evidence, if it becomes contentious, usually comes out on the winning side”. He further encouraged all creatives to take proactive steps in protecting their intellectual property by utilising the tools available to them, such as the Voluntary Copyright Registration and the Poor Man’s copyright services. “By depositing your work with JIPO and obtaining a copyright certificate, you add an extra layer of protection to your creations,” the manager added.
