Enforcement Gap - The Law Exists. So Why Is No One Being Held Accountable? Zambia, Zimbabwe & Malawi have legal provisions for sanctions against financial misconduct, yet meaningful accountability remains rare. Low-level public servants face penalties, but guilty senior officials, ministers, treasury secretaries & accounting officers face no consequences. Auditors-General report, Parliament debates….then nothing❗️No binding obligation to act, no tracking, no consequences🛑. Penalties must apply at all levels; audit recommendations must become legally binding & implementation must be reported to Parliament annually. Without enforcement, even strong laws remain hollow. @Jamwanda2 @tsunga_arnold Unfortunately things in this profession do not work that way. Lawyers have clients and those clients have a right to a lawyer of their own choice. Imagine if the JSC had reserved the use of IECMS for only trained lawyers upon its introduction? It just doesn’t make sense.

Why these law firms and not others? #Zimbabwe It is quite baffling why people and entities must be deprived the constitutional right to use lawyers of their choice. Why should some law firms get preferential treatment from the state? Why should some law firms face discrimination from equal opportunities? It does not make sense at all. This notice by the government to create opportunities and wealth for a few law firms is really in very bad taste and totally unjustified. Too many good law firms have suffered for too long in silence and this is not a good way to build a nation that respects the rule of law and a legal profession that is unified in self regulation. Such discriminatory practices of patronage in business risk dividing the legal profession. We run businesses and try hard to maintain high ethical standards but almost always get frustrated by this needless discrimination. I doubt that the Ministry of Justice thought through this policy properly and I would urge the Ministry to reconsider and allow the legal profession to operate on meritocracy rather than throttling fair competition. It is ironical that the notice ends by stating “access to justice for all by 2030.” @MoJLPA @lawsocietyofzim @SadcLawyers @ealawsociety

Africa Judges and Jurists Forum is pleased that our Programs Director @Dr_JAMavedzenge who is a Zimbabwean jurist and constitutional legal scholar has been appointed by the President of Seychelles, to Chair a Commission of Inquiry that is meant to investigate a prison riot that took place in Seychelles in 2024 following the intervention of security forces at the prison. The riot resulted is deaths and injuries of prison inmates. The Mavedzenge led Commission will inquire into the use of force during that riot and establish whether the force used was necessary, lawful and proportinate.
