BREAKING: On the last possible day, the Carney government has appealed the Federal Court of Appeal’s decision finding the invocation of the Emergencies Act unlawful and unreasonable to the Supreme Court of Canada. More to come.

The SCC's decision in Kanyinda has me coming back to Chief Justice Wagner's 2024 press conference, in which he lamented the loss of faith in institutions, attributed to "disinformation". As I wrote then for the @TheHubCanada, to the extent confidence in the Court has declined, it's arguably not due to disinformation from without, but disregard from within. Judicial decisions must broadly make sense to the public. No doubt many Canadians are now wondering how the Charter - which protects our essential rights and freedoms, and which even excludes certain rights many hold dear - could have anything to say about social welfare benefits to refugee claimants. Many will consider it utterly implausible that the legislative branch ever intended to cede its authority over such an important part of the public purse to the judiciary. And many will conclude that if judges are going to make political determinations, then they should be selected based on their politics. The politicization of judicial decisions, in other words, can only lead to the politicization of the judiciary. Unless we want to repeat the toxic American experience of the last half century, we need an abrupt jurisprudential course correction .
