You can drag a billion-dollar credit bureau into small claims court for $1,000 and they will fold rather than show up, because sending a lawyer to your local courthouse costs them more than just paying you Here's the law they pray you never discover. The FCRA requires bureaus to conduct a reasonable investigation and to correct or delete inaccurate information after you dispute it. When they DON'T, when they keep reporting an error you've disputed with evidence multiple times, that's not just negligence. That's a WILLFUL violation. And the law makes them liable for up to $1,000 in statutory damages per violation, PLUS any actual damages you can show (a loan denial caused by the error, a higher interest rate, a lost apartment), PLUS your attorney's fees and court costs The keyword that separates a nothing-burger from a payday is WILLFUL. A single error they've never been told about isn't enough. But when you've told them, shown them proof, and they STILL keep reporting it, that pattern of ignoring valid disputes is what makes it willful and what makes the $1,000 stick Here's how you build the airtight case: Step 1: dispute the error properly the FIRST time and SAVE EVERYTHING. Your dispute letter, the evidence you included proving the item is wrong, their response letter, and the certified-mail receipt with the date stamp. This is round one of your paper trail Step 2: when they "verify" the error without correcting it, dispute it a SECOND time, again with proof, again by certified mail, again keeping the receipt. In this second letter, note that this is your SECOND dispute on the same item, reference the date of your first dispute, and state that the error persists despite your prior notification. Now you've documented that they were told twice, given evidence twice, and kept reporting inaccurately anyway. That builds the willfulness Step 3: send a final demand before filing: "You have now continued to report demonstrably inaccurate information regarding this account after two properly documented disputes with supporting evidence, each sent by certified mail on [dates]. Your continued reporting of this inaccurate information despite repeated notification constitutes a willful violation of the FCRA. Correct or permanently delete this item within 15 calendar days, or I will file a civil action seeking statutory damages of $1,000, actual damages, attorney's fees, and costs as provided under 15 USC 1681n" Step 4: if they still don't fix it after the final demand, file in small claims court. Filing fees are usually $30 to $100. You represent yourself. You bring your paper trail: the two dispute letters, the evidence you sent, their failure to correct, and the certified-mail receipts proving dates. The case is simple: "I told them twice, proved the error twice, they ignored it twice, and the law says that's worth $1,000" Step 5: here's what actually happens when you file. The bureau does the math. Sending a corporate attorney to your local small claims court in [your city] to defend a $1,000 case costs them $3,000 to $5,000 in legal time, travel, and prep. Deleting the item and cutting you a check costs them $1,000 or less. So they delete the item, offer to settle, and ask you to dismiss. You win by being too expensive to fight, and the paper trail makes it clear they'd lose anyway Step 6: if you want to skip the small claims route, FCRA consumer attorneys will often take these cases on contingency, meaning you pay nothing upfront. The law forces the LOSING bureau to pay your attorney's fees, so attorneys love well-documented FCRA cases because they get paid by the bureau when you win A guy I know had a paid-off auto loan that kept reporting a $14,000 balance owed on his credit. He disputed it twice, each time including the paid-in-full letter from the lender as proof. Both times the bureau "verified" the $14,000 balance without correcting it. He sent the final demand. No response. He filed in small claims for $100. Rather than send a lawyer across the state to argue over it, the bureau deleted the item and mailed him a settlement offer before the hearing date. He won by filing a form Read that again. A regular person sitting at a kitchen table beat a billion-dollar corporation, because their own paper trail proved they ignored a valid dispute twice, and fighting him in court cost them more than folding They count on you believing they're too big to touch, too powerful to question, too corporate to bother with your little dispute.
