MaMkhize Fights Back in Court as SARS Moves to Sell Her Properties Over R40m Tax Debt Controversial businesswoman Shauwn “MaMkhize” Mkhize appeared in the Durban High Court today, Wednesday to block the South African Revenue Service (SARS) from auctioning off her properties amid a long-running tax dispute. Mkhize’s legal team argued that SARS’s urgent application to sell the assets should be struck from the roll, claiming the matter lacked urgency. Advocate Sinethemba Ndlovu told the court the application was only heard three months after papers were filed and should have been brought immediately after a preservation order was granted in November 2024. SARS is seeking to liquidate the properties whose locations were not disclosed in court because they are deteriorating, accumulating unpaid rates and levies, and losing value while under curatorship. The revenue service says Mkhize’s bank accounts are frozen, leaving no funds for maintenance. Advocate Hein Schyman SC, for SARS, told Judge Jacqueline Henriques: “Every day we stand here, the properties are worth less; they don’t pay rates and levies.” The revenue service wants to convert the assets into cash, which would be held in curatorship until the tax case is finalised. If Mkhize wins her tax battle, she would receive the proceeds back. Ndlovu countered that the properties in question are primary residences for her clients, though the judge questioned why this had not been stated in the affidavits. Judge Henriques reserved judgment. Mkhize, better known as MaMkhize and former owner of Royal AM football club, has been locked in a battle with SARS for years. The revenue service alleges she owes approximately R40 million in unpaid taxes. A preservation order obtained in November 2024 allowed SARS to attach assets, including luxury vehicles, which have already been auctioned in previous sales. The case also involves Mkhize’s ex-husband, Sbu Mpisane. Proceedings were briefly interrupted when Schyman objected to submissions made from the bar. The ruling is expected to determine whether Mkhize can keep fighting to retain her properties or if SARS will proceed with the sales to recover the outstanding taxes.
