Under the law, undocumented immigrants may only access federal benefits that are deemed necessary to protect life or guarantee safety in DIRE SITUATIONS. 2) Due to the Deficit Reduction Act (DRA) of 2005 proof of citizenship or legal status IS REQUIRED to receive Medicaid. Under this law, States must verify a person’s identity and U.S. citizenship before enrolling them in Medicaid. No ID equals no benefits — even for American citizens - until documentation is provided. 3) Due to the Affordable Care Act (ACA) of 2010 - better known as Obamacare - although it expanded access to healthcare coverage, it EXPLICITLY EXCLUDED undocumented immigrants from buying insurance on the healthcare. gov marketplace. 4) Under Medicare Rules (Social Security Act – Title XVIII), Medicare eligibility isn’t based on immigration laws directly, but on work history and LEGAL STATUS. One of the requirements to qualify for Medicare under this rule, is that you MUST be a U.S. citizen or LAWFUL permanent resident.
