من البارحة لليوم أكو ناس مسوية أزمة على موضوع: “شلون الابن يعتبر عراقي إذا أمه عراقية وابوه مو عراقي؟”. زين، بعيدًا عن الانفعال، خلونا نحچي بالقانون وبفلسفة التشريع نفسها. القانون العراقي ما جاب هذا الموضوع من فراغ، وإنما استند إلى مبدأ واضح: إذا كان الأب مواطن عراقي وعنده حق ينقل جنسيته لأولاده، فالأم العراقية أيضًا مواطنة كاملة، متساوية مع الاب او الرجل في حق المواطنة ومن الطبيعي يكون إلها نفس الحق. *ملاحظة هنا نتحدث عن المساواة في “المواطنة” وليس عن مسائل الأحوال الشخصية مثل الزواج أو الطلاق أو الميراث، فهذه أبواب قانونية وشرعية مختلفة تمامًا. ولهذا السبب نصّ الدستور العراقي بشكل واضح في المادة (18/أولًا) على أن: “العراقي هو كل من ولد لأبٍ عراقي أو لأمٍ عراقية”. يعني المشرّع حسم الموضوع دستوريًا، وبعدها جاء قانون الجنسية العراقية رقم 26 لسنة 2006 وكرّر نفس المبدأ في المادة (3/أ): “يعتبر عراقياً من ولد لأب عراقي أو لأم عراقية”. بل أكثر من ذلك، المادة (4) من نفس القانون أعطت إمكانية منح الجنسية لمن ولد خارج العراق من أم عراقية حتى لو كان الأب مجهولًا أو بلا جنسية، وهنا تظهر الفلسفة الإنسانية للقانون؛ لأن المشرع عالج مشاكل الأطفال اللي ممكن يواجهون ضياع الهوية أو انعدام الجنسية بسبب الحروب أو التهجير أو فقدان الأوراق أو غياب الأب. فالموضوع مو “مجاملة” للمرأة ولا قضية عاطفية كما يتصور البعض، وإنما مرتبط بعدة اعتبارات: - مبدأ المساواة في المواطنة. - الالتزام بالدستور. - مواكبة معايير حقوق الإنسان والاتفاقيات الدولية. - معالجة ظروف اجتماعية عاشها العراق لعقود بسبب الحروب والنزوح والتفكك الأسري. يعني ببساطة: المشرّع هنا انتقل من فكرة قديمة تعتبر الجنسية مرتبطة بالأب فقط، إلى مفهوم أحدث يعتبر الجنسية رابطة مواطنة بين الفرد والدولة، سواء جاء هذا الارتباط من الأب او الأم.
