חוק עונש מוות למחבלים - עשינו היסטוריה! ועונים לשאלות. חוק עונש מוות למחבלים הוא החוק ההיסטורי החשוב ביותר שעלה ועבר בכנסת ישראל בעשרות השנים האחרונות. מדינות אירופה תוקפות, החמאס בלחץ, ברשות משתוללים, ויש גורמים בשמאל שמנסים לזרוע ייאוש, לבלבל ולספר סיפורים על החוק ההיסטורי - אז בואו נעשה סדר פשוט וברור: מה החוק אומר? החוק קובע דבר אחד בסיסי: מחבל - דינו מוות! יש חוק כזה בדין הצבאי? נכון, אבל הוא מעולם לא יושם, בין היתר בגלל ההגבלות המחמירות שבו. בחוק החדש הוסרו כל החסמים: אין דרישה שהיועמ״שית תגיש בקשה, אין צורך בשופטים מדרגת סגן אלוף ומעלה בלבד, ואין צורך בהסכמה פה אחד בין השופטים. כל התירוצים שמנעו עד היום עונש מוות - בטלים ומבוטלים. זאת ועוד - מדובר בעונש חובה, שרק במקרים חריגים ומנימוקים מיוחדים ניתן לסטות ממנו למאסר עולם. בנוסף, החוק מאפשר גם לבתי משפט בישראל להטיל עונש מוות. זו היסטוריה! למה זה נדרש? כי המציאות הוכיחה לאורך השנים שיש מחבלים שרואים בכלא הישג - מקבלים כסף, מעמד וכבוד, ולעיתים גם יוצאים בעסקאות. נכון ששינינו את תנאי המחבלים מהקצה אל הקצה - ביטלנו את הקייטנות, את ארוחות ה”כל כלול”, את הלימודים, את הטיולים, את הטלוויזיה והרדיו, את הקנטינות ואת ההפקדות - אבל החוק הזה עולה שלב נוסף ומשנה את המשוואה: מי שיוצא לפגע - יודע שזה הסוף שלו. האם זה מוסרי? כן. מדינה שמגינה על אזרחיה, היא מוסרית. מי שבא לרצוח ילדים, נשים ומשפחות - איבד את זכותו לחיים. רחמים על מחבלים = אכזריות כלפי הקורבנות. החוק לא יחול על 100% מהמחבלים? החוק חל על רובם המכריע של המחבלים, מבלי לאפשר לשופטים להתחמק או לעקוף אותו. נכון שיש אחוזים בודדים שזה לא יחול עליהם, אך על הרוב המוחלט – כן, וזה שינוי היסטורי. אבל למה ויתרתם על הנוח׳בות? ממש לא ויתרנו. החוק חל גם עליהם. נכון שלצורך השלמה נדרשת גם חקיקה רטרואקטיבית, ובנושא הזה עוסקים חברי כנסת מהקואליציה ומהאופוזיציה. העונש עצמו ייגזר לפי חוק עונש מוות למחבלים, ובית המשפט יהיה מחויב להתייחס אליו, ללא תלות בעמדת היועצת. גזר הדין יבוצע תוך 90 יום באמצעות שירות בתי הסוהר. זה לא יעבור משפטית? הכנסת מחוקקת לפי מה שנכון וצודק - לא לפי פחד. בחרתם בעוצמה יהודית כדי לפעול בעוצמה יהודית, לפי הערכים שלנו - לא לפי סולם הערכים של שופטי בג״ץ. זה לא מושלם? אין חוק מושלם, אבל זה הכי קרוב למושלם. כששינינו את תנאי המחבלים בכלא - לעגו. אחר כך שאלו למה הם בכלל חיים. עכשיו, כשחוקקנו עונש מוות - טוענים שזה לא יעבוד. אתם כבר מבינים לבד… זה נגד העולם? זה נגד מחבלים. בארצות הברית יש עונש מוות, וגם שם מנהיגים מחזקים אותו. אותן מדינות שמבקרות אותנו היום, ביקרו גם כששינינו את תנאי המחבלים בכלא. לא חשוב מה יאמרו הגויים - חשוב מה יעשו היהודים. לסיכום: החוק הזה הוא צודק, ראוי ונכון. הוא מחזק את ההרתעה, מונע שחרורים ומביא ביטחון לאזרחי ישראל. גם לחוקים היסטוריים אחרים היו מתנגדים - והיום כולם מבינים כמה הם היו נחוצים. החוק הזה מבטיח דבר אחד: מי שבא להשמיד אותנו - לא יחיה כדי לספר על זה. ואם יש כאלה שמעקמים את האף - שילכו עם אף עקום. הבטחנו. קיימנו.
