@MattCann @delbified @roadcc Also, why are the Police saying they will now be prosecuted for not providing it? If they have sent a motoring NIP to the lease company as keeper, then they should have simply disclosed information on the potential driver, otherwise that is unlawful. How did they ask?

@JonnyStone @delbified @roadcc The offence is a summary only offence. Only trialable in a magistrates court. A production order has to be for an indictable offence trialable in a crown court.

@MattCann @delbified @roadcc The whole things smells of something, it could be total incompetence on either the Police or lease company, or something more sinister from either party. Finally can you explain what prevents the Police getting a court order in this case?

@peterbrownbarra @JonnyStone @roadcc You issue the Hort 1 to the driver. Not to the owner, as it is a driver requirement to produce your insurance certificate when asked by a constable.

@MattCann @JonnyStone @roadcc They could issue a horti to establish whether the vehicle was insured for that driver. His name will be on the insurance, and if he’s not insured that’s a traffic offence and they can demand driver details.

@delbified @JonnyStone @roadcc The leasing company can charge the police. There is a limitation to prosecute common assault which is six months. If they fail to reply there is nothing to compelling them to provide any data.

@MattCann @JonnyStone @roadcc they can't charge the police, but presumably you mean the leasing company. that's ultimately a commercial arrangement and not an excuse for the leasing company to fail to obtain it.

@SussexInspCC238 For me it's a numbers game. There are same amount of cops for me people. The kids I dealt with ten years ago have 3 or 4 kids. We are reaping what we failed to sow. You can't do more with less. You can only do what you can do.
