Zimbabwe Doctors Back Amendments Broadening Abortion Access The Zimbabwe Association of Doctors for Human Rights (ZADHR) has publicly endorsed Clause 11 of the Medical Services Amendment Bill to broaden access to safe termination of pregnancy in Zimbabwe. Under current law abortion is permitted only in limited situations such as when a woman’s life is at risk, serious foetal abnormalities, or rape and incest. In its statement ZADHR says the inclusion of Clause 11 “aligns with Section 76 of the Constitution of Zimbabwe, which enshrines the right to healthcare, as well as Sections 48, 51 and 52, which protect the rights to life, dignity and bodily integrity” and that it is a pivotal step towards improving reproductive health services. The association notes the Termination of Pregnancy Act of 1977 is outdated and that expanding access in regulated medical settings would reduce unsafe procedures and support informed medical decisions. Zimbabwe continues to see a high maternal health burden with many women treated each year for complications of unsafe abortion. Global evidence cited by health bodies shows restrictive laws do not reduce the number of abortions but increase unsafe practices. ZADHR says the Bill would help reduce preventable maternal deaths, protect girls and women from serious complications, and align Zimbabwe’s health framework with international public health standards. Girls’ rights groups press Parliament over unsafe abortion deaths among minors HARARE — A coalition of girls’ rights and women’s health organisations has escalated pressure on Parliament to fast-track amendments to Zimbabwe’s Termination of Pregnancy Act, arguing that delays are directly linked to preventable deaths and severe injuries among adolescent girls. The intervention comes as the Senate considers changes prompted by a High Court ruling that found the exclusion of minors from accessing safe, legal abortion services to be unconstitutional, breaching the right to freedom from cruel and degrading treatment. Health data cited by the coalition points to the scale of the issue. The 2023–24 Zimbabwe Demographic and Health Survey shows that 23 percent of adolescent girls have been pregnant, rising to 37 percent in some provinces, including Mashonaland Central. The World Health Organization has reported that abortion-related complications account for up to a quarter of maternal deaths among adolescents and young women under 24. The activists say the proposed amendment would bring the law into line with the Constitution and existing medical realities rather than introduce new abortion rights. Abortion has been legally permitted under specific conditions in Zimbabwe since 1977. Girls’ rights advocate Dean Mtata said the debate should be grounded in constitutional and public health obligations rather than ideology. “We must protect life today, and that means protecting the lives of our girls,” Mtata said. “The proposed amendment is not a policy of moral liberalisation; it is a constitutional imperative rooted in the principle that a child’s best interests are paramount.” He pointed to maternal mortality figures as evidence of the cost of inaction, adding that denying minors access to lawful medical care had been deemed unconstitutional by the courts. The push follows a November 2024 High Court decision recognising that excluding minors from safe abortion services violates constitutional protections. Separately, the court has also ruled that mental health risks can constitute grounds for legal abortion after a challenge brought by the Community Working Group on Health. That ruling now awaits confirmation by the Constitutional Court, after which Parliament will be required to amend the law. Women’s health advocate Pamella Memory Kadau said lawmakers must confront the data before them. “With 23 percent of our girls facing pregnancy, the legal structure must provide a safe path, not a death sentence,” she said, warning that failure to amend the law leaves adolescents exposed to unsafe, clandestine procedures. The coalition has also rejected proposals raised in public debate to replace the age of consent with the age of marriage, saying such a move would criminalise consensual sexual activity among unmarried adults and create widespread legal and social consequences. From the community level, Women’s Action Group executive director Loveness Rukuni said the effects of unsafe abortions are visible daily. “We know the devastating impact of unsafe, backstreet procedures on our young girls,” she said. “The Senate must deliberate from a position of truth, evidence, and its constitutional duty to protect all citizens.” The groups say the amendment before Parliament reflects existing court rulings and health evidence, and that further delay risks perpetuating preventable deaths and long-term harm among Zimbabwe’s most vulnerable girls.
