@milliardbillion There's a good reason we want cases to set precedent. Over time, the law becomes more clear and people can adjust their behaviors and agreements appropriately. Otherwise, legal outcomes would be much less predictable.

In her appeal, she argues that the court was wrong on both counts. The court does have personal jurisdiction over Bob and that Alice entitled to $5,000. The appeal is heard by a three judge panel. Each judge writes their own opinion: Judge 1: Bob should win. The court does not have jurisdiction over him, though if it did, Alice would win on the merits. Judge 2: Bob should win. The court has jurisdiction over Bob, but he wins on the merits. Judge 3: Alice should win. The court has jurisdiction and Alice should win on the merits. Two out of three judges make a holding. So the appeals court holds: A) Bob should win. (1 and 2 agree) B) The court has jurisdiction. (2 and 3 agree) C) Alice wins on the merits. (1 and 3 agree) So Alice loses her appeal (due to holding A). Bob does not have to pay her $5,000. However, she has now created precedent ensuring that if an identical suit ever happens again, the person in Alice's shoes will win (due to holdings B and C)! You see why it can be very hard to explain in simple terms what an appellate ruling actually holds?

Знаємо вже із сайту Національної асоціації адвокатів України, що 23 січня Єрмак поновив своє адвокатську діяльність. Це означає, шо він не має права суміщати її разом із військовою службою. То що так довго шукає МВС? Знайдуть таки Єрмака десь радником в своїх структурах МВС? Чекаємо чітку відповідь від МВС і підозру для потужного менеджера

There is actually both good data and solid scientific evidence that the more irrational you are in a negotiation, the better the deal that you ultimately get. It sounds counter-intuitive, but it really is logical. For example, suppose Alice wants to sell her car and Bob wants to buy her car. Suppose Alice would just barely be better off if she had $2,000 than the car and Bob would just barely be better off if he had the car than $3,000. Both Alice and Bob will be better off if Alice sells the car to Bob for any price between $2,000 and $3,000. If Alice and Bob are both rational and enter into a fair negotiation, theoretically the car should sell for around $2,500. But if Alice is unfair and irrational and refuses to sell the car for less than $3,000, Bob will still take the deal if he is rational! Alice being irrational makes her $500. Now suppose instead Bob is unfair and irrational and refuses to pay more than $2,000 for the car. Alice will still take the deal if she is rational! Bob being irrational makes him $500. So often negotiations (especially through agents) wind up with each agent trying to convince the other side that the party they represent is irrational and unreasonable and so will not take the deal that is equally fair to both parties to get a better deal for their side.

These dumbasses will never understand what a negotiation is. Let me tell you how it works for me, just as an actor. A movie offers me an amount for my services. My manager says "That's insane. Nick gets (SOME EXORBITANT AMOUNT) per week!" The movie goes back, talks amongst themselves and says, "we can come up THIS MUCH, but no further." My rep says, "Well that's just not enough. WHAT ELSE CAN YOU GIVE HIM?" The movie then says, "Well we can add this perq, and we can come up to this amount, but that is absolutely our best and final offer, take it or leave it." And most every time, the number they come up with is the one I had in my head that I would do the role for, and we make the deal. We ask for more, they compromise, We take the deal, I do the role, they feel like they got a bargain considering what I asked for, and everybody is happy. That is what Trump just did with Greenland, you blithering idiots, and he does it over and over and over again, and you are too stupid to understand what negotiations are. @fharris2011
