Senator Mark Kelly flew 39 combat missions in Operation Desert Storm as a Navy pilot deployed on the aircraft carrier USS Midway. He received two Distinguished Flying Crosses, four Air Medals (two with Combat “V”), two Navy Commendation Medals (one with combat “V”), and retired from the Navy with the rank of Captain. As a naval aviator and test pilot, he logged over 5,000 hours in more than 50 different aircraft and completed over 375 carrier landings. After his Navy career, he was selected as a NASA astronaut in 1996 and flew four space shuttle missions, including commanding Space Shuttle Endeavour’s final flight in 2011. His wife, Gabby Giffords, was a congresswoman who survived being shot in the head in an assassination attempt in 2011. But of course, with a convicted felon in the Oval Office, this is the kind of crap that happens.

OFFICIAL IGNORANCE by @DeptofWar and @SecWar @PeteHegseth Let me explain this for the MAGA idiots who think Democratic members committed sedition in violation of 18 U.S.C. § 2387 which makes it a crime to: "… with intent to interfere with the loyalty, morale, or discipline of the military or naval forces… advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces…" Reminding military personnel of the long standing U.S. military rule that service members are required to disobey UNLAWFUL orders is NOT a violation of 18 U.S.C. § 2387. 18 U.S.C. § 2387 does NOT contradict what military codes, rules, laws, and/or statutes do enforce. This statute is part of the broader "sabotage" and "subversive activities," and was primarily aimed at civilian sedition, Communist-era subversion, or enemy propaganda during wartime, or someone deliberately trying to incite mass mutiny or desertion. The statute 18 U.S.C. § 2387 requires a specific criminal intent: ​"Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States..." ​If a person or group advises service members to REFUSE unlawful orders, their intent is obviously to uphold the rule of law, the Constitution, and proper military discipline (which requires adherence to the laws of war and criminal statutes). This intent is directly contrary to the criminal intent required by the statute 18 U.S.C. § 2387. It is not intended to punish lawful instruction about the duty to disobey illegal orders. The military’s rule on unlawful orders is well documented in the Uniform Code of Military Justice (UCMJ), the Manual for Courts-Martial, and decades of case law (United States v. Calley (My Lai) and United States v. Kinder) — all of which hold that a service member has a duty to disobey an unlawful order. According to legal precedent, 18 U.S.C. § 2387 requires specific intent to impair loyalty, morale, or discipline in a subversive way. Telling troops, "You must disobey unlawful orders," lacks that subversive intent; it actually upholds discipline and the law of war. Military judges and the Court of Appeals for the Armed Forces (CAAF) have never interpreted 18 U.S.C. § 2387 as criminalizing proper instruction on unlawful orders. In practice, the statute has almost never been used against military instructors, lawyers, or commanders who teach the duty to disobey illegal orders. One of my brothers just sent me this photo of me in a street (which may have been outside a pub). Taken on film, by the time he gets it developed, you’ve forgotten you were ever there. I’m at home now and listening to a band called The Smiths singing the Queen is Dead, live, way back in 1986, which coincidentally, was when I was at college studying photography. Anyway, the image and the music seemed to work perfectly together, as can so often happen.
