Scott Gerber: Age is missing from the Compact’s list of illegal non-merit-based factors. I presume this was an oversight, and that the Trump administration would concur that, like all entities employing 20 or more people, it is illegal for colleges and universities to take an individual’s age into account in employment decisions. Indeed, the list is prefaced by “such as,” which is a phrase used to introduce an example or series of examples.
