I don't usually write on this topic but as a father, I could not in right conscience not. A 15 year old was raped. A tragedy that demands the full weight of the law's protection for her. Instead, the Supreme Court committed an act of profound inhumanity, which some people might argue should make these judges go to hell in short order and I would concur. AIIMS Delhi, India's foremost hospital told the Court the foetus was viable. At ~ 30 weeks, it would be born alive. Doctors warned that the procedure would not be a termination in any clinical sense, it would be a preterm delivery of a living child, one likely to be born with severe deformities, one that would need immediate neonatal care. AIIMS further warned that the procedure posed serious risks to the minor herself, potential permanent damage to her reproductive organs, long-term health consequences for a body still developing. The hospital's medical board was so alarmed that it took the extraordinary step of filing a curative petition against the Supreme Court's own order. This doesn't happen everyday, esp by a Government hospital. Noone likes to piss off the Supreme Court. Imagine how disturbed they were. The Court's response was to threaten it with contempt. THE apex medical institution said this will cause harm to both the minor and the child, and the Court ordered it anyway - because lawyers can play God while doctors hope their conscience can withstand it. The law is clear. And the Supreme Court violated it. Section 3(2B) of the Medical Termination of Pregnancy Act amended in 2021, permits termination beyond 24 weeks only if a State Medical Board certifies substantial foetal abnormality. No such certification was given here. The Court did not find a way through the statute. It rode roughshod through it, citing Article 142 the "complete justice" provision as a master key to override the law. The minor's suffering, she reportedly attempted suicide twice, demands humane intervention. But constitutional courts do not protect one person's rights by ordering medical professionals to perform procedures they believe will harm both their patient and a viable child. Or in this case, kill the child. At what gestational age does a foetus acquire interests the law must consider? The law drew a line at 24 weeks with abnormality as the only exception beyond it. The court ignored everything. Two people needed protection in this case, and the court literally pissed on them, and our collective conscience.

ASG Aishwarya Bhati: With profound pain we have to mention this curative. This curative is from AIIMS. Termination of pregnancy is not possible. It will be a live baby with severe deformities. Minor mother will have life long health issues and cannot reproduce. I am sorry I am not composed.. CJI Surya Kant: if the mother does not have permanent disability then it should be carried out. This is a case of child rape. Victim will have lifelong scar and trauma. This is foetus vs child fight. ASG: this is not foetus vs child fight. This is in best interest of child. Minor mother will have life long health issues. CJI: Even if she has complicated marital life later..is this pain more or that one. ASG: this child can be given for adoption. It has been 30 weeks now..it is a viable life now.
