"I complained about car finance and they said I wasn't mis-sold - is it over for me, so today's announcement is irrelevant?"... NO! I’m asked this a lot.. as until the middle of last year, the regulator, the FCA, was only investigating Discretionary Commission Arrangements (DCAs), and that is what complaint letters, including mine, were focused on. As you didn't know whether you had a DCA without asking, the first thing the letter did was ask if you had one. If you did, you were likely mis-sold. If not, they wrote back and said you "weren't missold." BUT... Since the Supreme Court ruling last year, there are now two other forms of mis-selling the FCA is likely to include in its redress scheme, covering millions of cases: 1. Contractual ties 2. Unfairly high commission Again, the key to both is that you were not told. And if you put in an original complaint about DCAs and were told you did not have a case, the regulator says it will still counts as a complaint, and the firm will have to check whether you were mis-sold in these two other ways once the mass redress scheme launches. So you do not need to do anything more for now. You are already in the fastest route, which is for those who have complained, and should be contacted if you are owed money.

@MartinSLewis Is there any route to find out who you had finance with if you don’t have paperwork and can’t locate it on your credit history?

@mjrw85 @MartinSLewis If you have started a claim through one of those firms,im afraid your contracted to them and cant pull out.you will be under contract to pay them a set % of any payout you are due,probably 25%- 35%

@MartinSLewis Because we thought it would be difficult to claim, we have all these claim lawyers doing it for us. They'd take a fee surely? Now it's easy to claim, I guess we don't need them?

Update: Since I recorded the video, the regulator the FCA has now said it will confirm before monday whether it is consulting on a #CarFinance redress scheme (likely primarily about DCAs, I think it'd be unthinkable for it not to after the #SupremeCourt decision)

@x4cld @MartinSLewis If you had finance before 2021 then you more than likely had a dca,this decision wasnt about the dca as martin has been telling you if you bother to read his posts

@matt_spriggs @MartinSLewis I contacted black horse in february as well and get the same reply every month,but 2 months ago thay sent me a letter with 8 agreements they could find back to 2009 all had DCAs on them

@MartinSLewis Been ignored by Black Horse since my initial contact back in Feb, just standard automated 'we're looking into your request within 28 days'. Emails stopped at the end of August and nothing since.

@MartinSLewis @TheFCA Further to having the same "we will be in touch" email from Black Horse,a letter in the post today listing all the accounts they could find which was 4 more than me😁😁. All 9 of them have a dca on them,lovely 👍

CAR FINANCE MISSELLING RECLAIMING IMPORTANT UPDATE The regulator, the @TheFCA has just announced the planned decision on whether firms systemically mis--sold car finance due to Discretionary Commission Arrangements will be moved from Sept 2024 to May 2025. More so it has delayed when firms must deal with complaints even further, to Dec 2025. Its announcement indicates there's a chance that in May it will launch a consultation on a redress scheme (& the Court will have decided on a key case by then), and the move to Dec is so it'd be able to finish that consultation before firms have to put it in place. Clearly the delay is disappointing for those awaiting a decision, including the 2m who've submitted complaints via the MSE free tool moneysavingexpert.com/reclaim/reclai…. Yet it does signal it's still looking favourably on ruling it is mis-selling and a payout is due - even though the finance firms have been pushing back hard both publicly and through the courts. Most important thing people can do it log their complaint asap, so that if there is a time bar, hopefully there's less chance of it being ruled out of time.

Motor finance misselling update: @TheFCA just announced while it'll announce it's ruling in May 2025 firms will have until December 2025 to deal with complaints.

@MartinSLewis @TheFCA So by moving the date further back this will be a year from originally making a complaint and 1 less years data the companies will have to keep on record. A loss for any complainants in my book ☹️
