SC DENIES DELA ROSA PLEA, SAYS MOTION FILLED WITH 'UNVERIFIED REPORTS AND ALLEGATIONS' JUST IN: The Supreme Court has denied Senator Bato dela Rosa’s request for a temporary restraining order and status quo ante order against his possible arrest over the ICC warrant, ruling he failed to prove a “clear and unmistakable right” that needed protection. In an eight-page resolution dated May 20, the court said Dela Rosa’s claims were still dependent on unresolved constitutional questions, including the enforceability of the ICC warrant after the Philippines’ withdrawal from the Rome Statute and the interpretation of Republic Act 9851. The court said Dela Rosa failed to establish “material and substantial invasion” of his rights, noting he was placed under Senate protective custody and that President Bongbong Marcos publicly stated he had not ordered the senator’s arrest. The SC further said the senator's very urgent manifestation was filled with unverified reports and allegations, with the pleading itself admitting that the cited reports, interviews, and video statements presented “material factual issues.” The court said it is not a trier of facts and cannot issue a stay or status quo ante order based on speculative allegations.
