Dále musí taky uspět u písemních testů. Jenže u fyzických testů ženy selhávaly častěji, než muži. U písemných (matematika, čtení, gramatika a schopnost sepsat zprávu) selhávali častěji Afroameričané, než běloši. Z toho důvodu byla SPM zažalována za diskriminaci. V US právním řádu může být diskriminací i tzv. "disparate impact" - nerovný dopad na některé skupiny, bez skutečného nerovného zacházení. SPM se podvolila, vyplatí 3 miliony neúspěšným uchazečům, některé z nich přijme přesto, že v testech selhali a změní způsob testování - diskriminace je paskvil, který by měl zmizet z našich právních řádů - rovnostářství je ideologie neslučitelná s meritokratickou, kompetentní společností - ženy jsou fyzicky méně zdatné, než muži - Afroameričané jsou méně inteligentní, než ostatní etnika v USA - poslední dva body jsou prostě fakt dán biologií, fungující společnost nemůže být postavena na lhaní o nich
