CLARITY ACT CLEARS SENATE BANKING COMMITTEE, ADVANCES TO FULL SENATE The Digital Asset Market Clarity Act passed its Senate Banking Committee markup today, advancing the most significant US crypto legislation in years to the Senate floor. Chairman Tim Scott opened the session at 10:30 AM ET with all 13 Republicans locked in after Senator John Kennedy committed Wednesday in exchange for a fiduciary duty provision for crypto participants and the attachment of the Build Now Act, a community development housing bill he co-sponsored with Senator Elizabeth Warren. Warren filed 44 of the 130+ amendments and watched them fall one by one along the 13-11 party line. Her amendments on sanctions authority, retirement-account exposure and bank supervisory records relating to Jeffrey Epstein each failed 11-13. Kennedy said he would have voted yes on the Epstein amendment if the phrase "co-conspirators" was stripped, but Scott moved on regardless. Senator Mike Rounds' AI sandbox amendment passed 15-9 with bipartisan support. Markets responded immediately. Bitcoin pushed above $81,000 and Coinbase shares surged more than 8% intraday. Polymarket odds of 2026 CLARITY Act passage repriced from the low 60s to 73% on Kennedy's Wednesday commitment. The ethics provision Democrats demanded, targeting government officials with crypto ties, falls outside the Banking Committee's jurisdiction and will be addressed at later stages. The bill still requires reconciliation with the Senate Agriculture Committee's parallel version, a full Senate floor vote, House reconciliation and a presidential signature. The White House target remains July 4.

In a statement, one of the lead GOP negotiators, @SenLummis, said: “Ultimately, we have agreement on 99% of the bill. I hope my colleagues across the aisle will work with me to get the remaining 1% resolved after we pass this bill out of committee. Otherwise, when or if another FTX happens, we will have no one to blame but ourselves.” Democrats like @SenAdamSchiff and @SenRubenGallego had been pushing to reach a compromise on ethics/conflicts of interest involving the First Family ahead of tomorrow’s markup as a condition of their support for the bill, while other Democrats voiced eleventh-hour concerns about provisions tied to the Blockchain Regulatory Certainty Act (BRCA), which would prevent non-custodial software developers from being prosecuted under money transmitter laws.
