I was in Ottawa during the protests, and later at the public inquiry. I saw ordinary Canadians do something not everyone is willing — or able — to do: stand up to government overreach when it mattered most. The Federal Court of Appeal decision affirms why that matters to a democracy. Free societies depend on citizens who are prepared to say “no” when power exceeds its limits. Not everyone can take that stand, but we should be proud of those who did. What I witnessed were not extremists, but patriots — people who faced pressure, force, and condemnation from an increasingly authoritarian government. Today, the Court reminded us that democracy survives because some are willing to defend it.

Kenneth Paulin, 51, was sentenced to nine months in jail and two years of probation on September 18 for the wilful promotion of hate against Jewish people and the wilful promotion of antisemitism by condoning, denying or downplaying the Holocaust. Paulin was arrested and charged by the North Bay Police Service in June following a seven-month investigation into his antisemitic online content. His posts vilified the Jewish community, promoted blood libels and conspiracy theories, incited hate and violence against Jews and repeatedly mocked and denied the Holocaust. The false claims have a demonstrated potential to cause harm by encouraging overly aggressive public health policies and interventions. The incorrect construct ψ was first introduced and applied by Fisman et al. in an April 2022 article in the Canadian Medical Association Journal and repeated by Fisman et al. in an April 2024 article in PLOS ONE.
