I agree with Romain Robert that the CJEU decision in Brillen Rottler is saying nothing new: as any other right under EU law, such right van be abused under certain circumstances.

✅ Permite a la fiscalía asegurar datos informáticos por hasta 90 días
✅ Crea la figura del agente encubierto digital
✅ Autoriza interceptación de comunicaciones con orden judicial
✅ Regula registro y secuestro de sistemas con cadena de custodia
✅ Regula la investigación en fuentes abiertas.
