I READ BAIL ORDER IN THE CASE OF ALLEGED RAPE OF 3 YR OLD BABY GIRL IN A SCHOOL IN DELHI & HERE'S WHY COURT GRANTED BAIL : ◾Parents alleged that the incident happened in a basement in the school on 30 April b/w 8:15am - 12 noon where a female teacher was also present during the assault. Defense argued that the Accused had a job of only monitoring the entry of teachers & students at the gate & claimed he never even entered the school. He is seen leaving the school at 8:37am to go to senior wing where he is seen entering at 8:45am and did not go anywhere from there till 12 as seen in CCTV footage ◾ Defence claimed that the initial complaint from parents did not mention presence of school teacher during the assault but when she did not support the parents version, she was also falsely implicated ◾The most important fact observed by court was of medical report. No injury or redness or scratch or any marks were found either on the body or private parts of the child though complaint was made on same day and medical done shortly thereafter ◾Court also took into account arguments of defense that there were several students & teachers in the premises in morning hours of the school & it is highly impossible that no one heard the cries of the child subjected to alleged assault ◾Without going into merits of the case, Judge said that as even Investigation officer has agreed that the accused left the premises at 8:37am and did not enter the school again and that the school and the accused have cooperated in the incident, technical evidence have been taken into custody and teachers have been examined, bail is granted Delhi Police has categorically mentioned that they provided immediate support & assistance to the victim & the parents and vehemently opposed the bail. Special PP demanded that the accused not be granted bail as allegations are grave Meanwhile, the female teacher added as an accused later in the case was arrested yesterday after the case was given a political colour by leader of a certain political party. She is in police custody right now
