PIL by BJP leader Ashwini Upadhyay seeking biometric and facial recognition of voters before vote is cast CJI Surya Kant: This will require great change in rules and also a great financial burden. Ofcourse power is there with ECI Upadhyay: ECI has plenary powers. But states also need to co-operate. Notice is needed CJI: ECI needs to give us a reply and if state does not help or finance ministry does not pass budget then again we can be approached. But issuing notice at this stage is not needed Upadhyay: I am not on the five states elections. CJI: The prayers cannot be considered for the upcoming elections. But whether such a recourse deserves to be followed for next parliamentary elections or state polls needs to be examined. Issue notice.
