@ProfRobAnderson We measured this once for judicial opinions. The most highly cited predominantly cite recent cases, with a few older cites sprinkled in (i.e. low mean high variance). Articles likely to be quite different though.

Building on methods from our previous work, we also show that courts (somewhat surprisingly) don’t vary the amount of explication about the identity or behavior of the PHOSITA depending on whether the invention at issue is routine or highly unusual. 5/5

@tripperhead Cap. 599I relies on emergency authority granted by Cap. 599 § 8, which itself requires the CE to declare an emergency in relation to a specified public health threat. The current emergency declaration is in relation to Covid-19, not influenza.

The CE should roll back as many of the emergency regs as possible asap, especially the most visible like Cap. 599I mandating masks everywhere. Although note that this is scheduled to expire today and thus far, no gazetting of extensions (@tripperhead any updates on this?)

@ortospace Hong Kong is a useful rebuttal to the 'but Japan' justification for mask mandates. We've still got a mask mandate here (even outdoors!) and have infection and death numbers as high or higher than many places where masking is unusual.
