@RyanPrestage @phillymike223 @cathyrusson So, the way our system is structured, SCOTUS is binding on all states (generally). But Oregon’s SC followed SCOTUS’ holding in 2022. It is interesting though because a deft. always had the right to a unanimous jury in first degree murder cases. And I agree, but we’re biased 🙃

@ryanwilson2003 @phillymike223 @cathyrusson This is a strong argument, I acknowledge. Yes, I remember SCOTUS ruling Louisiana had to be unanimous a couple of years back. When did Oregon change? Great name, by the way.

@RyanPrestage @phillymike223 @cathyrusson There is inherent value in an unanimous verdict. It indicates a clear, unambiguous message and consensus. Because it’s not about innocent or guilty- it’s about the burden. Some states allowed for non-unanimous verdicts (Oregon and Louisiana) but this is no longer the case.
