Adnan, you may come to regret opening this discussion. It will not unfold in your favour. Let us begin by clarifying the fatwa of Sayed Khomeini. Both Sunni and Shi‘i legal traditions operate upon a foundational principle: everything is considered permissible unless there is clear proof from the Qur’an or Sunnah establishing its prohibition. This is not a casual claim but a deeply rooted juristic maxim. What follows is a legal analysis, not an emotional one, and it must be understood within that framework. There is no explicit text in the Qur’an or Sunnah that categorically prohibits certain forms of non-intercourse physical contact with a minor. Based on the principle mentioned, such acts may be classified, in isolation, as permissible. However, and this is crucial, permissibility in principle does not equate to permissibility in practice under all circumstances. The reader must understand these words of Sayed Khomeini are found in his book of jurisprudence. An act may be theoretically permissible yet practically prohibited due to surrounding conditions. This is where many fail to grasp the distinction. The first essential point is that scholars have deemed the validity of a marriage contract involving minors, provided certain strict conditions are met. But validity does not mean unrestricted allowance. A fundamental condition for such a contract is the absolute absence of harm. If any form of harm, physical, psychological, or otherwise, is present or even reasonably anticipated, the legitimacy of the marriage itself collapses. Therefore, if it is established that such a marriage inherently causes harm to the minor, then it is not valid in the first place. The legal framework already contains within it the mechanisms to prevent abuse. It is not an open licence, but a conditional ruling tightly bound by safeguards. One might then ask: why did Islamic law permit such a framework at all? The answer lies in the diversity of human societies and historical contexts. Social structures, environmental realities, and communal needs have varied widely across time and place. In some contexts, marriages were contracted without immediate cohabitation or consummation, often due to distance, tribal arrangements, or socio-economic factors. Reducing this discussion to crude caricatures reflects a lack of seriousness and an unwillingness to engage with the legal tradition as it actually exists. The second point is equally important: when Islamic law declares something permissible, it does not imply endorsement, encouragement, or moral desirability. Permissibility is a legal category, not a moral recommendation. To illustrate: the permissibility of eating meat does not render all meat lawful in every circumstance. It remains subject to conditions. Likewise, a jurist stating that a particular act is permissible under specific conditions is not advocating for it, but merely clarifying that it is not intrinsically prohibited. For instance, The Holy Prophet (s) prohibited domestic donkeys and prohibited temporary marriage during the Battle of Khaybar, even us the Shi'a accept this. We have reliable reports regarding this in our books. However, the difference is that this prohibition is a governmental ruling. It was a governmental decision that the Prophet (s) saw it fulfills a particular interest so he prohibited it. Thus, if any act, even within a valid marriage, results in harm, it immediately becomes prohibited. The ruling shifts based on context. The legal system does not require scholars to enumerate every possible scenario; rather, it provides principles that govern all scenarios. Where harm exists, prohibition follows. 🚨 Everyone has their limits and breaking point A Nottinghamshire man blew up his house after his rent was increased by £80 😔 David Howard warned multiple friends he was going to blow his house up after his rent was increased by £80. The 53-year-old had lived at 26 John Street in Worksop for 11 years when he caused a fatal explosion - which resulted in his and his dog's death - on April 12, 2025. On the same day, he had received a letter from his landlord, Sarah Reilly, to inform him his monthly rent, which was mostly paid by Bassetlaw District Council, was going to go up by £80 to £540. At about 3pm, he began telling a number of friends that he was going to "blow the house up", saying "you wait until the end of the day", an inquest into Mr Howard's death was told on Monday, March 30. One of his friend's accounts of the events on April 12 was detailed by DC Daniel Akehurst during the proceedings. Shanelle Williams told officers Mr Howard had told her on the day that he was "p****d off and could not cope anymore" due to his rent going up. Ms Williams described Mr Howard as "in a mood and depressed". The woman was then called by Mr Howard at around 3pm, when he told her "he had pulled the pipes" and made comments about "blowing up the house". In another call at 3.29pm, Mr Howard told Ms Williams "I’ve done it, I’ve pulled the pipes off the gas. It’s going to go with a bang." The latter call lasted 42 seconds and was ended by Mr Howard before Ms Williams could say anything. Before this, Mr Howard had told friends he had been up for three days with no sleep and was "very upset" about the rent increase". A friend tried to give him advice but he wasn’t listening, with Mr Howard saying, "you watch, you wait until the end of the day" and "you wait to see what happens". The inquest was told Mr Howard had made similar comments before April 12. Around 3pm, Mr Howard locked the doors to the property he was renting after two of his friends left to go to a shop, which was described as "strange". Upon returning, the two friends were told by Mr Howard to "go, I don’t want anyone else to get hurt. Please just go". Asked by his friends if they could at least take his dog, Roxy, Mr Howard said: "Roxy is staying with me." The hearing wasn't told any of the friends made any attempts to notify emergency services of the events.
