No Shyla. A single sex space is UNLAWFUL if it does not fall under one of the exemptions in the equality act. To fall under the Schedule 3 exemptions, it must be a PROPORTIONATE means of achieving a LEGITIMATE aim. If it isn't, it ain't lawful.

The first sentence is true but doesn’t get you where you think it does. Yes, workplace provision must comply with the Equality Act. But the Workplace Regs do not themselves decide Equality Act access rules, nor do they erase gender reassignment protection. The EA allows sex-separated provision in certain circumstances. It does not turn every sex-separated facility into a purity rule. Schedule 3 still requires the relevant statutory conditions to be met, and para 28 still exists where gender reassignment is engaged. So “single-sex facility” is not the end of the analysis. It is the start of the Equality Act analysis. Why should I be “grieving” about anything? We’re just discussing the law and your flawed understanding of it, you really have very peculiar ideas about simple legal debates—but do continue if you must.

That is a facilities-provision rule, not an Equality Act access rule. The FWS judgment is likewise confined to the Equality Act 2010. At para 2, the Court expressly says it is not defining “woman” generally, but only as the word is used within the EA 2010. So you can’t export the FWS ruling into other legislation and pretend the Workplace Regulations answer the Equality Act question. Different statute, different function. The Regs say what facilities must exist; the EA says when treatment in providing or operating them is lawful. And the EA really doesn’t say what you think it does as we’ve already determined because you don’t understand how services are defined or how Schedule 3 exceptions apply to the protected characteristics of Sex and Gender Reassignment. Sadly for you, no amount of insults make up for your evident ignorance. But I’m quite happy to leave you to your ignorance fuelled bliss. Enjoy, bye.

Hello Shyla. It would be UNLAWFUL discrimination to have a single sex facility or service UNLESS you meet one of the exemptions in the Equality act. The most commonly used being the Schedule 3 exemption that it is a proportionate means of achieving a legitimate aim.
