▪️₹1 lakh cost imposed on woman who had filed gang rape case but later claimed FIR was lodged due to a “misunderstanding” ▪️High Court observed that allegations as serious as gang rape cannot be made casually and later withdrawn conveniently. ▪️Court noted that “the integrity of the man has been severely ruined by the allegations levelled by the complainant who conveniently submitted that the FIR was got lodged due to misunderstanding.” ▪️The accused persons had approached the High Court seeking quashing of the FIR after the matter was amicably settled. ▪️While quashing the FIR, High Court observed that continuation of criminal proceedings would be an “exercise in futility” as chances of conviction were bleak after the compromise. ▪️However, Court remarked that “such kind of misadventures by women” demean the stature of women in society and deserve strict treatment. ▪️Accordingly, FIR was quashed subject to payment of ₹10,000 each by the accused persons and ₹1 lakh by the complainant within 1 month. ▪️Court also directed that if the complainant fails to deposit the amount or pressures the accused to pay on her behalf, State shall recover the amount as arrears of land revenue by attaching her properties and assets.
