Her name was Priyadarshini Mattoo. She was 25 years old. A Kashmiri Pandit who had fled militancy in Srinagar with her family and rebuilt her life in Delhi. She was in the final semester of her LLB at Delhi University’s Campus Law Centre. Her senior in college was a man named Santosh Kumar Singh. His father was JP Singh, a senior IPS officer who would go on to become Joint Commissioner of Delhi Police. Santosh became obsessed with Priyadarshini. She rejected him. He began stalking her. She filed FIR after FIR. The police did nothing. Her father went to the university. The university did nothing. She was eventually given a personal security officer. The stalking continued anyway. On the morning of January 23, 1996, her security officer did not show up for duty. Santosh knocked on the door of her uncle’s house in Vasant Kunj where she was staying. A servant saw him enter. What followed took less than an hour. She was found under her bed. Strangled with an electric wire. Her face battered beyond recognition with a motorcycle helmet. She had 19 injuries on her body. DNA evidence linked Santosh directly to the crime. His fractured helmet visor was recovered. Witnesses placed him at the scene. In 1999, Additional Sessions Judge GP Thareja delivered his verdict. He said in open court I am convinced he is the man who committed the crime. Then he acquitted him. He said the CBI had fabricated the DNA evidence. He gave Santosh the benefit of the doubt. The Delhi High Court later called this verdict a perverse approach that murdered justice and shocked the judicial conscience. It took public outrage, media pressure and her aged father appearing on television for years before the High Court took up the appeal in 2006. Within 42 days, the High Court convicted Santosh and sentenced him to death. The Supreme Court upheld the conviction in 2010 but reduced the sentence to life imprisonment. He has since been granted multiple paroles. In 2019, he was given parole to appear for his LLM examination. The man who raped and murdered Priyadarshini Mattoo is studying law in prison. Her father fought for 10 years to get a conviction the judge already had in his hands in 1999. The verdict said police were reluctant to act on her complaints because Santosh’s father was a senior officer. It said junior staff do not react to complaints against the relatives of their fraternity. She filed FIR after FIR. Nobody moved. Not until she was dead. I had covered this case in my book Blasphemy. I had used this very case as an example of political privilege in India. I had predicted nothing will happen to Mr. Thakur. But if the same words are uttered by an average Indian they will go to jail. I think this judgment is sound because hate speech should also be legal in my view. Serving army officer argues own divorce case before Supreme Court: Wife: I am not here against divorce (divorce has already been granted). I am challenging the remarks and findings on cruelty and desertion made against me by the family court and high court. They may be expunged. Husband: I had to fight 10 years to get my parents’ name out, my sister’s name out and my name out from the allegations she had made against me and now she wants that they be omitted. Please see the allegations which were put on me. First allegation, trying to convert her religion, trying to murder her, sexual determination and gender bias, pressurising her to terminate pregnancy, harassment for dowry, demanding dowry, stalking, threatening with weapon… I had to fight 10 years to get my name cleared from this. Till date they have taken out about 57 lakhs from me. Court: they have taken out means what? It’s according to the family court’s order. Husband: in another matter they have to return 11.7 lakhs to me. Court: that’s a different matter, you have got recourse to the courts for that. Husband: the maintenance which they have taken from me is on a false affidavit. They have misled the family court. She has filed two contradicting affidavits. Court: contradicting doesn’t mean that it’s false. Court: What were the allegations in the divorce suit? Wife: cruelty in terms of not staying with him in his place of work, desertion that I did not go with my daughter to his house and instead I went to my parents’ house. I wanted to open my dental clinic in Ahmedabad has been used against me. Saying that I don’t want to join my husband in his place of work, knowing that he’s an army man. Court: yes, wife having own work, there’s nothing wrong with that. Court to husband: are you standing the risk of getting this judgement of high court reversed? [the judgement which had granted divorce based on wife’s cruelty]. We don’t think a single allegation in your petition amounts to cruelty, if you seek our opinion. Do you want to take that risk? Husband: the charges that were put on me… Court: let things be over. Forget about the past and move on. That’s more advisable for you. Husband: it took me 10 years to get my name cleared from the charges which she had put against me. Court: you also dragged her here till Supreme Court. (The husband has filed a perjury case against the wife for the alleged contradictory affidavits) The court ultimately reserved its order in the case.

A MURDERED MAN HAS LESS SERIOUSNESS IN EYES OF LAW THAN WORDS OF A WOMAN I feel totally lost today. Over the last few years, I have personally worked with men who are victims of #falserape cases who spent anything from 5 months to 5 years in false rape cases. No matter how many proofs they had of their innocence, courts did not grant them bail merely because "allegations" & "charges" against them were serious as recorded in their bail rejection orders BUT I am seeing women being granted bail within days or months even when they played an active role in the death of a man whether in abetment to suicide cases or even MURDERS !!! WHAT EQUALITY IS THIS? NOT EVEN 1 YEAR IN JAIL !!!?

In the last 2 weeks I have learnt of 3 so called rape cases where Supreme Court has sent these cases for "MEDIATION" CASE 1: Woman stole jewellery from house of neighbours. When he complained she retaliated with rape case. She moved Supreme Court after anticipatory bail was rejected even by HC. Supreme Court sent the case for "mediation" Case 2 : Married woman in consensual relationship with married man. Man has reached Supreme Court for anticipatory bail. Case sent for "mediation" Case 3 : Woman & Man in live-in relationship. Child born out of the relationship. Woman then filed rape case alleging false promise of marriage. SC sends the case for "mediation" AFTER MOCKERY OF 498A NOW RAPE LAWS ARE BEING MOCKED A Heinous crime like rape will now be mediated which basically means monetary settlement or demands of woman being met whatever it is. God save this country
