🚨 Our Response to the White House’s National Policy Framework for Artificial Intelligence We welcome policy initiatives that promote free speech and access to information in the context of artificial intelligence. At the same time, much will depend on how these principles are ultimately defined, implemented, and enforced in practice. In this regard, we commend the Policy Framework’s commitment to defend the First Amendment and its efforts to prevent government coercion and attempts to censor expression or compel speech. It is also encouraging that, unlike recent Executive Orders, the framework does not emphasize neutrality or “truth-seeking.” At the same time, previous statements and initiatives framed in culture-war terms counsel caution in assessing these positive developments. Importantly, we hope that the framework's emphasis on "preventing AI systems from being used to silence or censor lawful political expression or dissent" means that federal and state governments will be prevented from using AI platforms as a tool for censorship, and not that AI platforms will be compelled to generate content that violates their own policies. Additionally, the framework's age assurance recommendation gives us pause. While framed around parental attestation rather than hard ID verification, it still conditions access to lawful speech on identity disclosure, which Reno and Ashcroft strongly suggest will not survive strict scrutiny. Any scheme in which the government mandates a requirement for identification before accessing information chills the anonymous readership that the First Amendment has long protected.
