1. Disclosure & Copy
Article 14 Popular Culture & Arts Act memang menyebutkan disclosure. TAPI, dalam praktik audit (dan standar kontrak FTC), disclosure tanpa hak salinan itu Informasi yang Tidak Sempurna. Gimana akuntan mau kerja kalau cuma 'numpang baca'? Makanya CBX perjuangkan hak salinan demi audit independen yang akurat.
2.Kalah dan Dismissed
Kamu bilang mereka 'kalah'? Sifatnya itu PROSEDURAL dong bukan substansial. Artinya hakim merasa permohonan nya belum memenuhi syarat teknis saat itu, BUKAN berarti SM benar secara materiil. Menganggap penolakan prosedur sebagai 'kemenangan mutlak' itu sesat logika hukum.
3.Pidana dan Perdata
Kamu bilang soal 5,5% sudah di dismiss polisi? Itu ranah PIDANA (dugaan penipuan)😅. Dalam hukum, kalau laporan pidana di dismiss, bukan berarti WANPRESTASI (Perdata)-nya hilang. Polisi nggak ngurusin tuh tarif distribusi musik, itu urusan Hakim Perdata di persidangan yang baru mulai ini.

4.Lawsuit & Countersuit
Lawsuit SM soal 10% dan countersuit CBX itu satu paket. CBX menahan 10% karena SM diduga melanggar kewajiban (tarif 5,5% & transparansi). Ini namanya pembelaan Exceptio Non Adimpleti Contractus, kyk saya nggak bayar karena kamu nggak penuhi janji kamu. Kayak gitu
5.Pihak Ketiga & Provisional Seizure
Pengacara CBX nggak perlu jawab soal pihak ketiga lah ngapain? karena TIDAK RELEVAN dengan kewajiban SM.
Itu cuma taktik Red Herring (pengalihan isu). Soal pembekuan aset? Itu prosedur standar (conservative measure) buat 'menjamin' uang ada selama sidang.
Asal ada nilai sengketa, hakim gampang aja nge approve. Bukan berarti menang materiil ya.
Jadi, jangan bangga bilang 'Take the L' cuma karena prosedur administrasi ditolak. Pertarungan aslinya ada di Sidang Perdata nanti. Jangan sok modal kutip pasal kalau bedain ranah hukum dasar saja masih berantakan, ngono loh😉

Aduh, pusing dah kalo dibales tanpa kasih sumber yang valid. Modal ‘katanya’ gimana sih? Itu kan putusan resmi semua legal channels yang didatengin CBX? Argue with the whole judiciary system of South Korea gih. Di Artikel 14 Popular Act itu gak ada klausa wajib ngasih “salinan”, yg wajib itu cuma DISCLOSURE; nunjukkin. Pihak artis ya emang berhak2 aja kalo mau minta, tapi pihak agensi juga berhak nolak di luar dari kewajiban disclosure, yang mana udah secara regular di-provide SM (di-confirm sama Ministry of Culture setelah investigasi). SM udah bilang jg kalau mereka bahkan dibolehin bawa representatif atau akuntan sendiri. Masalah ttg konfidensial, gue cuma nge-quote statementnya SM. Ada alesan valid dan reasonable knp mereka nolak di awal. Dan yang di-file CBX itu gak cuma document submission order (yang ditolak2 juga), tapi injunction request dan banding yang semuanya KALAH. Kenapa masih keukeuh CBX tuh belom pernah “kalah” sih? Namanya legal efforts, complaints, injunctions, etc. kalau ditolak, di-dismiss, gagal, tuh ya KALAH. With regards to that particular filing. Gak berarti main lawsuitnya yg kalah, karena emg belum juga sidang. But they did lost ALL their filings, complaints, and appeals so far. Satu lagi: lawsuit SM dan countersuitnya CBX itu BUKAN tentang 5.5%. Yang ini juga udah di-dismiss sama kepolisian DAN kejaksaan. Lawsuit SM itu masalahnya contract performance yang 10%, dan CBX (masih) nge-counter masalah settlement statements. Again, masih aja ngemasalahin yg taun 2023 lah, 2024 lah, padahal CBX di October 2025 juga udah nerima semua syarat dari SM. They’ve taken the L already. Maybe you guys should too.

Just a reminder, speaking as someone in the legal field. Civil litigation are never a 'quick' process they are long, complex, and take time. While i hope tomorrow proceedings aren't dragged out, we must stay patient.
