If he only initially sprayed her for 2 seconds, it wouldn’t be assault, but he laid on the trigger for several seconds, even after any reasonable interpretation of imminent threat was neutralized. That’s where it becomes the point that they are now both guilty of assault. What he did was considered excessive. He wanted to punish her, which was evidenced also by how he followed her with the lense as she left. He was a dick

Woman loses her mind over being on camera decided to destroy property and got treated to two cans of spray. ​We are at the United States Post Office in South Pasadena, California, where this incident involved a physical confrontation, damaged equipment, and a deployment of pepper spray. ​The incident began inside the post office lobby, where the cameraman was filming in public exercising his constitutional rights. A female customer inside the lobby objected to being recorded, leading to a brief but tense verbal exchange. ​The situation rapidly escalated when the woman took it upon herself to grab and damage the cameraman*s recording equipment. The confrontation spilled outside onto the post office steps, where she grabbed onto the cameraman's monopod. During the physical struggle over the gear, the cameraman deployed pepper spray directly at her to break her grip and regain control of his equipment but not before she commits battery. Officers from the South Pasadena Police Department arrived on the scene shortly after. Following a review of the cell phone footage captured during the encounter, police issued the woman a criminal citation on the scene for misdemeanor battery and vandalism (the cameraman noted his $400 monopod was broken during the scuffle). True to form from law enforcement from California where they allow criminals to b get away with anything they want. You can bet if the roles were reversed they would have put the guy in cuffs. ​While a citation was issued, the local police department cannot formally file charges; instead, the case packet was forwarded to the Los Angeles County District Attorney's Office (Alhambra Branch) for review. Public records do not currently show a formal update on whether the DA pursued prosecution or declined the case, which is common in complex misdemeanor altercations involving mutual allegations of assault and self-defense. ​ What are your thoughts on how this situation was handled? Are you surprised by the lack of action from the local PD?

She was right in front of him , just step up to her and grab it, not continue to unload the entire can of pepper-spray. She was just trying to get him to stop recording her, she wasn’t trying to steal his stuff. Guaranteed that if he did nothing, she would have thrown it to the side and left. Do you really think she went to the post office with the idea of stealing video equipment?
