As the 5th of August approaches and the EHRC Code of Practice comes into force, many in the trans community will be getting nervous, so here are some of my thoughts. 1) Under the Equality Act, the protection against discrimination under gender reassignment remains in force - the Supreme Court judgment does not affect those rights. 2) There is no hierarchy of rights - gender does not trump sex - sex does not trump gender. 3) The EHRC Code of Practice, which is coming into force, has little effect in the workplace. 4) Blanket bans are very difficult to justify - in almost all circumstances, discrimination has to be justified by way of a “proportionate means to achieve a legitimate aim”. 5) Translucent’s Freedom of Information data, gathered over three years (in relation to local authorities), shows there is only very rarely an issue in toilets and changing rooms. Use spaces with that knowledge. 6) The EHRC Code of Practice suggests that people can be asked about their sex - there has to be legitimate reasons for doing so. There is no legal obligation on anyone to reply verbally to any such request - people are free to walk away from any confrontation without offering a reply 7) Some trans people have suggested to me that in the event of being challenged they are going to carry a card saying they dont speak English. In a civilian situation, this is not illegal. 8) The Equality Act is largely a legal tool to tackle discrimination - in most circumstances it is not a tool to justify discrimination. The EHRC Code is guidance, not law. 9) Your human rights under ECHR remain unaffected. 10) If you're trans and worried about this judgment or the Code, in most everyday situations (shops, transport, restaurants, most public services), nothing has changed. The ruling and Code only affect a narrow category of services that are lawfully single-sex (like changing rooms, refuges, or hospital wards), and even there, exclusion is only lawful if a provider can show it's proportionate - a blanket policy without that justification is likely unlawful. You remain protected from discrimination and harassment because of gender reassignment in every other context. Oh, and by the way - trans people are truly awesome

Calling this a “puberty blocker trial” hides what it actually is, so let’s be clear about what this medical pathway involves. It starts with a lie. A cruel and unusual lie. Children as young as 11 are told by trusted adults that they were “born in the wrong body.” They will be given drugs that suppress the hormones responsible for puberty. These are GnRH analogues, the same class of drugs also used to treat conditions such as advanced prostate cancer and to chemically castrate sex offenders. But this is not simply about delaying puberty. For many children, it will be the beginning of a heinous medical pathway. Puberty is the process through which children physically and psychologically mature. Multiple older prospective studies of children with gender dysphoria (followed into adolescence or early adulthood) found that the large majority, often cited around 60–90%, with some reviews putting persistence at only ~15%, desisted without medical intervention. Many later came out as gay or lesbian. Comorbid conditions are common: autism spectrum rates in clinic samples have been reported as high as 20–26% (versus roughly 1–2% in the general population), along with high rates of anxiety, depression, and other mental-health issues. Instead of watchful waiting and addressing those underlying factors, they risk being placed on a pathway towards cross-sex hormones. Even “cross-sex hormones” sounds benign. In reality, these are powerful drugs that permanently alter the body. Their risks include reduced bone density and osteoporosis (Cass Review systematic reviews found consistent moderate-quality evidence of compromised bone density during treatment), infertility (especially when puberty blockers are followed by cross-sex hormones, which interrupt gamete maturation), sexual dysfunction, vaginal atrophy and dryness in females taking testosterone, irreversible voice deepening in females, and vocal changes and breast development in males taking oestrogen, alongside other lifelong health consequences. The Cass Review concluded there is no high-quality evidence that puberty blockers improve gender dysphoria, body satisfaction, or mental/psychosocial health, and that long-term outcomes remain largely unknown. For an increasing number, the pathway does not end there. It progresses to irreversible surgery. Even those surgeries are given benign names, “top” and “bottom” surgery. Again, let’s call this what it is: men will have their penis removed, split down the middle and sewn between their legs; women will have their breasts removed, then part of their arm (or other tissue) cut off and sewn between their legs. Data from adult NHS gender services show thousands of referrals annually for such procedures, disproportionately involving young females. This is not simply a “puberty blocker trial.” It is the potential first step on an irreversible medical pathway with lifelong consequences. Studies consistently show that the vast majority of those who start puberty blockers proceed to cross-sex hormones, continuation rates of 90–98% in multiple Dutch, UK, and other cohorts. The drugs do not reliably “buy time to think”; they appear to lock most onto the medical pathway. The pathway starts with a lie: “You were born in the wrong body.” And ends with a lie: “You have changed sex.” Children are not capable of giving informed consent to a medical pathway with lifelong, irreversible consequences. Referrals to UK gender services rose from under 50–210 per year in the early 2010s to over 5,000 by the early 2020s, with a marked shift toward adolescent-onset cases, predominantly females.
