Immigration authorities later refused her Humanitarian & Compassionate (H&C) application and expected her to leave Canada. But the Federal Court found serious problems with the decision. The Court held that immigration officers failed to properly consider: ✅ Her long establishment in Canada ✅ Her serious health challenges ✅ Her close relationship and caregiving role with her grandchildren ✅ The emotional and humanitarian realities of her situation The Court criticized the lack of compassion in the decision and ruled that the refusal was unreasonable. PSYCHOLOGICAL REPORT CANNOT FIX CREDIBILITY ISSUES The applicant claimed refugee protection based on fear of persecution and argued that mental health challenges, including depression and anxiety, affected her ability to give consistent testimony. A psychotherapist’s report was submitted to support her case. However, the Refugee Protection Division identified multiple credibility concerns, including: • Inconsistencies in testimony • Contradictions in documents • Amended evidence that raised concerns • Gaps in important details surrounding her claim The Federal Court agreed with the tribunal and held that while mental health evidence can be important, it cannot automatically cure major credibility problems in a case. The Court emphasized that decision-makers can still assess the overall evidence and determine whether the explanations adequately address the inconsistencies. BARIKDER v CANADA (2026 FC 475) FEDERAL COURT SETS ASIDE CANADA VISITOR VISA REFUSAL BACKGROUND Glory Barikder applied for a Canadian visitor visa to visit her parents in Canada and assist her father who was recovering from a car accident. Her application was refused based on concerns about: • Family ties • Purpose of visit • Financial situation • Alleged unexplained lump sum deposits However, the Federal Court found that the visa officer failed to properly assess and explain the financial evidence provided — especially the financial support documents from the applicant’s father in Canada who had agreed to sponsor her visit. The Court emphasized that visa officers must: ✔ Properly engage with the evidence before them ✔ Provide logical and reasonable explanations for refusals ✔ Avoid making conclusions without adequately analyzing supporting documents As a result, the refusal was set aside and the application was sent back for reconsideration by a different officer. CASE SUMMARY:(Tijani v. Canada, 2026 FC 444): Refugee Claim Refused Due to Inconsistencies & Credibility Issues The Federal Court has dismissed the judicial review application of Kehinde Eniola Tijani, a Nigerian refugee claimant because of major credibility problems. Background: Tijani said she feared harm from her family and her fiancé’s family in Nigeria due to claims of “abomination” and threats of cleansing rituals. However, the RPD and RAD found serious inconsistencies between: Her Basis of Claim (BOC) form, Her oral testimony, Her timeline of events and Her supporting letters Key Credibility Issues Identified The Court highlighted several problems: She told the RPD she feared her own family, but her BOC said she feared her fiancé’s family. She testified about being physically attacked, but this major event was missing from her BOC. Her timeline of events changed between her written narrative and her testimony. Letters from her father and fiancé were nearly identical, leading the RPD and RAD to conclude they were not genuine. The Court quoted the RPD’s concern that the letters were “nearly identical in language and formatting,” making them unreliable. Courts Decision The Federal Court ruled that: The RAD’s credibility findings were reasonable. The inconsistencies were major and central to her claim. The RAD properly considered her mental health but found no evidence that it affected her ability to recall key events. The documentary evidence she submitted was general and did not prove she personally faced persecution. Because of this, the Court upheld the refusal. Key Lesson for Refugee & Immigration Applicants This case shows how important it is for: - Your BOC, testimony, and documents to match - Your story to be consistent and detailed - Support letters to be authentic and credible - Major events not to be omitted from your BOC Inconsistencies — even small ones — can destroy a refugee claim.
