Bandi Bageerath POCSO Case: BONE TEST FOR THE VICTIM The argument of a section of shameless Telugu media and others is that the victim has multiple proofs of birth. First - a driving license case where there is no proof of birth involved but just random age assumptions Second - GHMC record says victim’s DOB is 12-08-2008 Third - Passport says victim’s DOB is 12-08-2010 In case of multiple date of births, what does courts consider in cases like POCSO? There is a landmark judgment of Jarnail Singh v. State of Haryana (2013), the Supreme Court of India confirmed that the matriculation or equivalent certificate is the highest-rated statutory option and acts as a conclusive proof for determining a minor's age. Simple! Evidentiary Hierarchy 1: Matriculation or equivalent certificate issued by an examination Board. 2: Date of birth certificate from the school first attended (if Tier 1 is absent). 3: Birth certificate issued by a Municipal Corporation, local authority, or Panchayat (if Tiers 1 and 2 are absent). 4: Medical opinion/Ossification test (only as a last resort in the absence of all certificates). So those demanding Bone Test to determine the age of the victim. Firstly! You are absolutely stupid inhuman scum of the earth. Second - when 1 /2 /3 criteria aren’t met courts will go for Ossification (Bone) test. Reminder: Bandi Bageerath son of Union Minister Bandi Sanjay applied for an interim bail in a POCSO case.
