The documents may look complicated, but let’s break it down in a way that’s easy to understand. Who’s Involved? Plaintiff (person suing): Donald Berk Defendant (company being sued): Metallicus Inc., a financial and crypto services company What Is Mr. Berk Claiming? Mr. Berk says Metallicus treated him unfairly and broke employment laws. His main claims are: Wrongful Termination He says he was fired illegally because he spoke up about things he thought were unethical or possibly illegal inside the company. Age Discrimination, Berk is over 40. He claims he was paid less than younger workers with less experience. Discrimination in Pay, He says older employees were given lower pay and management tried to hide their ages. What Laws Are Involved? California Fair Employment and Housing Act (FEHA): Protects workers from discrimination, including age. California Gov. Code § 12940(k): Requires employers to stop retaliation and discrimination. California Civil Code § 3294: Allows extra (punitive) damages if a company acts with malice or oppression. What Does Mr. Berk Want From the Court? Money damages for lost pay, benefits, and emotional distress. Punitive damages (to punish the company). Attorneys’ fees. Injunctions (court orders to stop unfair practices). Is This a Criminal or Civil Case? This is a civil case, not a criminal case. Civil case = disputes between people or companies, usually about money or rights. Criminal case = the government charges someone with breaking the law (like theft, fraud, or assault). Berk’s lawsuit is about compensation and fairness, not jail or criminal punishment. Are These Proven Facts? No. At this stage, these are allegations claims made by Mr. Berk. Metallicus will have the chance to respond and present its side. A judge or jury will decide the truth based on the evidence. What the Case is NOT About It’s important to understand: this lawsuit has nothing to do with Metallicus’s technology or the @MetalBlockchain itself. The complaint is about employment practices (hiring, firing, pay, discrimination). There are no allegations about how Metal Blockchain works, its code, its security, or its cryptocurrency operations. No claims of patent infringement, hacking, or technical fraud. In short: this is about workplace treatment, not blockchain technology. When people hear “lawsuit against a crypto company,” they might think the technology is being attacked. That’s not the case here. This lawsuit focuses only on: Workplace discrimination Wrongful termination Retaliation for raising concerns Pay practices It does not focus on: Metal Blockchain’s design, functionality, or legality The Berk v. Metallicus lawsuit is an employment dispute, not a technology or blockchain issue. Mr. Berk claims he was treated unfairly because of his age and because he raised questions about internal practices. The court will now decide if those claims are true. Metallicus’s blockchain technology is not on trial here the case is strictly about how the company allegedly treated an employee.
