There are people who have successfully challenged and won cases against the FBI. The agency hasn't always gotten it right. Take Brandon Mayfield, for example. In 2004, the FBI mistakenly identified his fingerprint as a match to one found after the Madrid train bombings. He was arrested, but was later exonerated after the error came to light. He ultimately received a $2 million settlement from the U.S. government, and a federal judge ruled that aspects of the surveillance conducted under the USA PATRIOT Act were unconstitutional. That said, I understand your point. In Abu's case, if the authorities genuinely have sufficient evidence to prosecute him, then his chances of successfully challenging the case would likely be much lower.
