The Fight for Fair and Legal Elections Continues The Executive Order signed by President Trump on March 31, 2026, titled "Ensuring Citizenship Verification and Integrity in Federal Elections," has triggered a wave of rapid legal and administrative developments over the last few days. Here is the latest news: Major Multi-State Lawsuit Filed On Friday, April 3, a coalition of 23 State Attorneys General (led by Minnesota's Keith Ellison) filed a federal lawsuit to block the EO. •The Argument: The states contend the order violates the 10th Amendment and Article I, Section 4 of the Constitution, which grants states—not the federal government—the authority to manage the "Times, Places, and Manner" of elections. •Voter Suppression Claims: They argue that by forcing the USPS to only deliver ballots to a federally approved "Citizenship List," the order effectively overrides state-level voter registration and mail-in ballot laws. Civil Rights Challenges On April 2, a separate lawsuit, League of Women Voters of Massachusetts v. Trump, was filed by the Brennan Center for Justice and the ACLU. •This suit specifically targets the use of the SAVE (Systematic Alien Verification for Entitlements) database to compile the citizenship list, arguing the database is notoriously inaccurate for voter eligibility purposes and could result in thousands of eligible citizens being flagged as ineligible. USPS and "Intelligent Mail" Barcodes The EO mandates that the Postmaster General initiate rulemaking to require all mail-in ballots to be placed in secure envelopes with unique Intelligent Mail barcodes. •The Conflict: Legal experts and some election officials have pointed out that the USPS is an independent agency governed by a Board of Governors. There is ongoing debate today regarding whether the President has the authority to dictate which specific mail the USPS can or cannot deliver based on a federal list. •Logistical Concerns: Election officials in states like Arizona have noted that the EO’s requirement to submit a recipient list 60 days before an election conflicts with many state laws that allow voters to request ballots much closer to Election Day. Criminal Prosecution of Officials A notable development in this EO compared to the March 2025 version is the directive to the Attorney General to prioritize the prosecution of election officials and ballot printers who distribute federal ballots to "ineligible" voters. This has caused significant concern among local clerks who fear they could be held criminally liable for what they claim to be clerical errors or for following state laws that conflict with the new federal directive. We have already shared in previous posts that this EO is providing tools, data and solutions to make existing Federal laws easier to follow by the states. The Unite4Freedom analysis shows that the magnitude of the errors found in the election data demonstrate that the issues are not simple ‘clerical errors’ – the patterns suggest something more than random mistakes, but even if incompetence is the excuse the clerks want to use, the numbers of errors found demonstrate gross negligence. We need to demand Valid, Certifiable elections and we need to demand accountability. We are seeing a complete loss of control of our elections and without a safe and legal election process, we cannot protect our Constitution Republic, or express the will of the voters when we hold an election. Even if you do not agree with our conclusions, there is one point that offers no room for argument. Right now, we cannot know who has won any election because the results cannot be proven. We are finished with the era of ‘Trust us’ related to election outcomes and We are Now in the Era of “Prove it!” Join Unite4Freedom and help us restore fair and legal elections!

The absolute state of the London liberal. Here we have a woman, likely a member of the "educated" elite, clutching a "Stop Bombing Iran" sign. She’s confronted by an Iranian woman—someone who has actually lived under the thumb of that regime, someone who has been imprisoned by them, someone who cannot even return to visit her father's grave. Does the protester listen? Does she pause to consider the reality of the "regime" she’s indirectly defending? Of course not. She offers a vacant, condescending smirk. It is a perfect distillation of the modern Left: prioritising performative virtue and anti-Western slogans over the lived reality of the very people they claim to care about. They’d rather side with a theocratic, oppressive regime than admit that the bad guys aren’t those in the West. Total and utter woke vapidness.

One of the most devastating things I've seen as a career prosecutor is families slowly watching their children ebb away into addiction — and so many times, that leads to death. Donald Trump can sign any Executive Order he wants, but he can't change the Constitution. The states have the authority to set our election rules — and we're going to continue to have free, fair, safe, secure elections in Pennsylvania. And in case Trump forgot: we beat him and his allies 43-0 in court when he tried to overturn the will of Pennsylvania voters in 2020. As Governor, I’m going to continue to protect our democracy and the right to vote.

They’re not Fighting the EO. They’re fighting Accountability! Since President Trump signed Executive Order 14399, titled "Ensuring Citizenship Verification and Integrity in Federal Elections," on March 31, 2026, several states and advocacy groups have mobilized to challenge it. The Typical cast of characters has shown up: Marc Elias: Known voting rights litigator stated on social media that his team is prepared to sue immediately, arguing that the President lacks the unilateral authority to dictate how states manage mail-in ballots. Lawyers’ Committee for Civil Rights Under Law: This group issued a formal denunciation, arguing the order is designed to intimidate voters and create a "de facto" national voter database, which they contend is unconstitutional. ACLU & League of Women Voters: These organizations have signaled that they are reviewing the text for immediate filings, particularly focusing on the "tracking barcode" requirement as a potential burden on the right to vote. The simplest argument for the constitutionality of the Executive Order (EO) centers on the same clause in the Constitution that critics are trying to use as the basis for their claims, the "Elections Clause" of the U.S. Constitution and the existing federal mandate to maintain accurate voter rolls. Proponents argue that the EO is not an overreach, but rather a directive to ensure federal agencies comply with laws already on the books. While states generally "prescribe" the manner of holding elections, the Constitution grants Congress the power to "make or alter such regulations" at any time. The Argument: Because the EO directs federal agencies (DHS, SSA, USPS) to assist in a process Congress has already authorized—ensuring only eligible citizens vote—the President is simply using Executive Branch resources to enforce the "supreme Law of the Land." Both the National Voter Registration Act (NVRA) and the Help America Vote Act (HAVA) actually require states to maintain accurate and current voter registration lists. The Argument: The EO doesn't create a new law; it removes "administrative friction." Under the NVRA, states must conduct a general program that makes a reasonable effort to remove ineligible voters. By ordering federal agencies to share citizenship data, the President is providing the tools necessary for states to fulfill their existing federal obligations under these Civil Rights laws. The President has a Constitutional duty to "take Care that the Laws be faithfully executed." (Article II, Section 3) The Argument: If federal law (such as the 1996 Illegal Immigration Reform and Immigrant Responsibility Act) prohibits non-citizens from voting in federal elections, the President has the authority to direct federal agencies to provide data that prevents a violation of that law. In this view, the EO is a logistical directive to ensure federal data isn't being "siloed" in a way that allows federal law to be broken. Regarding the postal mandates, the argument is even more direct: The Argument: The United States Postal Service is a federal entity. The President has broad authority over the operations of federal agencies and the protection of federal property (the ballots once they enter the mail stream). Mandating security protocols like unique barcodes is framed as an operational security update for a federal service, rather than an interference with state law.
