🇭🇺🇪🇺HOW CONVENIENT. Just days before Hungary’s parliamentary elections, the European Commission *openly* admitted it has activated the Digital Services Act’s “rapid response system” to police “potential disinformation campaigns.” EU-funded “fact-checkers” will meddle with Meta, TikTok & others to throttle, label or even disappear content they dislike in a European election—or else face severe fines from Brussels. Of course, the Washington Post’s Russiagate-redux—claiming that Russian disinformation teams, Russia-Russia assassination plotters and Russia-Russia-Russia are lurking everywhere in Hungary—will not be flagged. The @JudiciaryGOP’s warnings about the DSA are basically being proven true in real time. The EU is making up for what USAID once did—& as @MikeBenzCyber pointed out long ago, the EU is taking over where USAID left off. Thankfully, @elonmusk is trying to resist exactly this kind of interference. And Hungary is, too.

On March 12, 2026, Karol Nawrocki, President of Poland, announced that he would not sign into law the act passed by the Polish Parliament authorizing the €43.7 billion EU SAFE credit for Poland. Security Action for Europe (SAFE) is an EU loan program that enables the financing of defense procurement through long-term, euro-denominated debt issued by the European Union. That same morning, representatives of the Ordo Iuris Institute met with @M_Kotecki at the Presidential Palace in Warsaw, handing over 38,000 signatures from citizens appealing to President Nawrocki to veto the act. Ordo Iuris had also submitted to the President legal analyses highlighting the unacceptable transfer of sovereignty that would accompany the SAFE 45-year credit. 👉Read our analysis on the rule-of-law conditionality mechanism embedded into Council Regulation (EU) 2025/1106 of 27 May 2025 establishing the Security Action for Europe (SAFE) through the Reinforcement of the European Defence Industry Instrument: ordoiuris.pl/en/analyses/th…

🛑The New SAFE mechanism to finance defense in the EU: another tool for exerting influence on member states? ➡️Read the Ordo Iuris analysis that shows how the Conditionality Regulation entails numerous risks for the disbursement of funds to EU Member States under SAFE: ordoiuris.pl/en/analyses/th… ⚠️First, the EU Conditionality Regulation will apply to the SAFE Regulation. ➡️Secondly, as the analysis shows, the EU institutions have already paved the way for the broad application of the Conditionality Regulation. The Hungarian and Slovak examples demonstrate that it can be used as a means of pressuring Member States pursuing policies normally independent of the EU in a wide variety of areas. 👉🏻Third, the broadly worded provisions of the Conditionality Regulation create room for the European Commission to intervene amid an ongoing rule-of-law dispute as it has done in Poland. ➡️Fourth, among liberal commentators and, occasionally, politicians, there are recurring calls to "starve" governments that are deemed populist by cutting off their sources of funding. ➡️Fifth, the sensitivity of the issue regulated by the SAFE Regulation (security) makes it politically very risky to oppose the threats coming from Brussels. ❌As in the case of NextGenerationEU, despite the lack of disbursement of funds, the Member State would have to bear the costs of repaying the debt!

🟢On February 3, the European Parliament in Brussels will host the 7th Transatlantic Summit of the Political Network for Values @PNfValues, an international network of conservative politicians and activists from both sides of the Atlantic. The Ordo Iuris Institute was a co-organizer of the previous Transatlantic Summit of the Political Network for Values, which took place in December 2024 in the Spanish Senate. This time, the co-organizers on the European side are the European Conservatives and Reformists @ecrgroup and Patriots for Europe @PatriotsEP groups in the European Parliament. ❌EU migration and asylum policy is not an exclusive EU competence; core powers over borders, security, and admissions remain with member states. 🛑The upcoming EU Migration Pact risks deepening failures, encouraging mass migration and forced relocations while deportations remain ineffective. ❌Renationalization aligns with subsidiarity, democratic accountability, and international law, rather than undermining the EU. 👉🏻The new report Taking Back Control from Brussels: The Renationalization of the EU Migration and Asylum Policies, prepared by the @MCC_Budapest in Budapest and Hungary’s @mri_hungary in cooperation with @OrdoIuris, addresses one of the most pressing political and legal challenges facing Europe today: the loss of national control over migration policy. 👉🏻The report provides a practical, immediate legal roadmap for member states to reassert control while respecting existing treaties and obligations. @jerzKwasniewski, @rodballester, @YannCaspar, @VMarsai, @gonczi_robert, @BalazsOrban_HU Read more: ordoiuris.pl/en/reports/tak…

🛑Just before Christmas, the Court of Justice of the European Union delivered a judgment that challenges the primacy of the Polish Constitution within Poland. 👉🏻According to the CJEU, Member States are not empowered to assess independently whether EU institutions, including the CJEU itself, have exceeded the powers conferred on them by the Treaties. 🛑This ruling runs counter to the principle of conferral of competences enshrined in the EU Treaties. 🛑It also contradicts the jurisprudence of the constitutional and supreme courts of several major Member States (including Germany, France, Italy, Spain, and Poland), which have repeatedly reaffirmed that rulings issued by the CJEU outside the fields of competence transferred to the EU by the Member States are to be considered invalid by national courts. COMMENT: The European Parliament's resolution endorsing the 'My Voice, My Choice' initiative is the latest example of the EU's growing and deeply troubling overreach into areas that remain, in theory at least, the exclusive competence of Member States, writes @jerzKwasniewski. brusselssignal.eu/2025/12/how-eu…

‼️CJEU puts itself above national constitutions in landmark case against Poland‼️ ❌Last Thursday, the Court of Justice of the European Union ruled that it alone will decide which competences have been conferred on the EU. 😮This marks the end of the principle of conferral of competences—and, effectively, the end of national sovereignty within the EU. 👉Read the full article: ➡️ordoiuris.pl/en/press-newsd…
