@KenyanSays The problem starts with you not doing research and asking relevant questions b4 you take the policy... Most of these agents lie and dont explain the terms and conditions in full because if you know what you are walking into you may ask for a better deal or walk away..

@ntvkenya Free advice. Stop paying the loan.. Save upto 100k go back to your lender and request for a discount if you can pay the loan in the shortest time they will offer target a 50% discount and see how it plays. During this period you are not paying play asif life is really hitting you

@kelvinkabu @mwangi_wadawa @DavisThuranira This can't happen... The patient should have been informed possible conversion to open surgery if things don't work out before the surgery.. During surgery is a matter of saving patient life... Not seeking a 2nd consent..

FIBROIDS & MEDICAL NEGLIGENCE.
In 2019, a woman with uterine FIBROIDS walked into the Nairobi Hospital for laparoscopic surgery by Dr. Thagana, a senior Obstetrics Gynaecologist with 40+ years of experience.
However, in the course of surgery, Dr. Thagana decided to abandon the laparoscopic surgery and convert to an open surgery without consent. He removed the uterus and later said that the fibroids were too large for laparoscopic surgery.
2 days after the surgery, she woke in pain and wet bedding and ended up losing her ability to control urine. Infections, pelvic abscesses, and other complications followed. She had to be moved from HDU to ICU and stayed in hospital for months.
Following her complaint to the KMPDC, the doctor was found guilty of professional misconduct and ordered to compensate the victim. He appealed to the High Court.
The High Court noted that the patient had actually signed the consent form, not to consent but to refuse consent. The doctor had no right to take any step further. The patient had a right to refuse treatment.
The court also faulted the doctor for failing to take basic preliminary steps. Finding calcified fibroids was not surprising because they had been diagnosed 10 years earlier.
If the doctor had undertaken the preliminary procedures and radiological investigations, it would probably have revealed the presence of calcification. The results would have enabled the patient to make an informed choice as to whether to proceed with the surgery.
As a specialist, a higher degree of skill was required of him than a doctor who doesn't profess such special skills and training.
The High Court found him liable for negligence.
Nairobi Hospital was cleared and absolved of liability since Dr. Thagana was not their employee but an independent doctor who was using their facilities. The court found that the facilities provided were not questioned, nor did they contribute to the injuries. Dr. Thagana was held personally liable.

The level of medical negligence in this country will break your heart into pieces. At this rate, we may need a specialised medical court because KMPDC and other regulators are either incompetent or compromised or both.

@mwangi_wadawa @DavisThuranira In this life you always need a plan A and Plan B... All patients undergoing laparascopic surgery are alway prepared for open surgery just incase things don't work out and the patient should be made aware of this..

@DavisThuranira Jaba ,gynecologist can perform hysterectomy without consent if it's emergency case,their license allows,if he performed laparascopic but fibroids due to multiple enlarged pose danger,he can abandon said procedure and perform one to save patient
