This is a real post, and from the real Iranian Consulate in Najaf. If Iran is going to be charging tolls for ships passing through the strait, I don't want to hear anyone talking about "the art of the deal" and how Trump's a genius. This allows Iran to formally hold the SoH hostage.

Failing to call this a war crime is pure excuse-making. Trump isn't threatening strikes on military infrastructure; he is threatening "stone ages", destroying ALL bridges, and destroying ALL power plants, plus water desalination plans. This is the definition of a war crime.

Calling this a "war crime" is pure fearmongering. Under ICRC Rule 10, strikes on infrastructure used for military purposes are permitted. Civilians are NOT the target. Grifters just bank on their audience being too stupid to notice.

Your enlistment in the Marines is a commendable achievement. It is common to overlook the extent to which LOAC contributes to the maintenance of our service members' morale, reputation, and credibility. The deliberate targeting of electrical infrastructure is considered a war crime according to United States’ Law of Armed Conflict (LOAC) when it involves civilian objects and disregards the principles of distinction or proportionality in the attack. All service members are legally obligated to prevent the commission of war crimes. In accordance with United States legal principles, adherence to orders is not recognized as a defense for perpetrating war crimes, hence the provision of pertinent training during the GWOT.

@davidprush @barnes_law I did that too when I was AF. When I went to the IC I did more. My issue is that people are out here telling troops to not obey orders and essentially injecting themselves into the chain of command. Some doing so by threat and doing it with no understanding of process. Shameful.

That's the exception not the rule. It is without question a war crime to annihilate a country's vital infrastructure. I was not engaged in target acquisition or the determination of target legitimacy; however, I underwent annual training in the Law of Armed Conflict (LOAC) during my service in the Air Force, as all service members are obligated to prevent the commission of war crimes. In accordance with United States legal principles, adherence to orders is not recognized as a defense for perpetrating war crimes, hence the provision of pertinent training. Sedition is a matter for legal professionals such as Barnes. It is my impression that the First Amendment imposes a high standard for prosecution.

@davidprush @barnes_law I mean, manufacturing is everywhere. Look at how embedded our military production is in our communities. It wouldn't be any different. One of the largest buildings in Scottsdale is General Dynamics. Nobody can build everything away from where the people who build it live.

In accordance with the principles of distinction and proportionality, power pruduction and bridges may be considered legitimate targets if they qualify as military objectives, provided they are not exclusively for civilian use or indispensable for civilian survival. Notwithstanding, the legitimacy of dual-use infrastructure is questionable when the collateral damage is disproportionately high compared to the military gains.

@davidprush @barnes_law So you seem to be saying they can play by whatever rules they want (bomb civilian airports, impact civilian energy by closing the strait) and we can't even target power production or bridges used to support military purposes? Lawyers are going to be the downfall.

As a constitutional lawyer, his achievements are among the most impressive in the field. Federal United States code, as legislated by Congress, establishes the parameters for LOAC. Federal statutes remain in effect, irrespective of any perceived war crimes committed by an adversary.

It is the epitome of obsequious flattery. Biden’s tenure saw Democrats exhibit this capability, followed by the MAGA movement under Trump. The susceptibility of a country to authoritarianism, whether from the Communist left or the Fascist right, is easily discernible. Are the President and military obligated to adhere to legislation enacted by Congress? One should recognize that through treaty ratification, the United States Congress has elevated international law to the status of federal law. Indeed, while the United States does, to a degree, determine which international laws it adheres to, the President is nonetheless constrained from disregarding legislation passed by Congress. To disregard the protective provisions of the Law of Armed Conflict for service members is indicative of a lack of understanding.
