As a tease for what is coming later -- but also because I get tired of Weissmann being rolled out as a legal authority on anything -- my article will begin thusly: "Andrew Weissmann “left” DOJ in the weeks following the Supreme Court’s 9-0 decision reversing his crowning achievement as head of the Enron Task Force, the conviction of Big Five accounting firm Arthur Anderson. Here are the facts surrounding his departure: Weissmann was part of the Enron Task Force when it was created in 2002, and became Director in 2004. But the Enron investigation began prior to the Task Force being formed, and was handled by Weissmann in the Fraud Section of DOJ’s Criminal Division. It was then moved to the Enron Task Force when Weissmann moved. The indictment was handed down in March 2002, and the trial was in May-June 2002 — the facts were largely undisputed and the issues at trial mostly involved “intent” and a legal interpretation of the “obstruction” statute Weissmann relied upon. The conviction led to Arthur Anderson’s collapse as a company, with 85,000 jobs lost world-wide, and 30,000 jobs lost in the U.S. The Supreme Court reversed the conviction of Arthur Anderson on May 31, 2005. The vote was 9-0 that the theory used by Weismann was constitutionally unsound — with Antonin Scalia agreeing with Ruth Bader Ginsburge that Weissmann didn’t know what he was doing. DOJ announced Weissmann’s departure from the Enron Task Force on July 18, 2005 — 6 weeks after the verdict. When Weissmann joined the New York law firm of Jenner & Block in January 2006, the firm’s announcement said he was “Special Counsel” to FBI Director Mueller from July to December 2005 — strongly suggesting Mueller saved him from being politely "asked" to leave DOJ in the aftermath of the Arthur Anderson FIASCO. From the Supreme Court’s opinion in Arthur Anderson, commenting on the legal theory pressed by Weissmann in the trial through the jury instructions he urged the trial judge to use: "The instructions also were infirm for another reason. They led the jury to believe that it did not have to find any nexus between the “persua[sion]” to destroy documents and any particular proceeding…. [T]he Government relies heavily on §1512(e)(1), which states that an official proceeding “need not be pending or about to be instituted at the time of the offense.” It is, however, one thing to say that a proceeding “need not be pending or about to be instituted at the time of the offense,” and quite another to say a proceeding need not even be foreseen. A “knowingly … corrup[t] persaude[r]” cannot be someone who persuades others to shred documents under a document retention policy when he does not have in contemplation any particular official proceeding in which those documents might be material." Basically, Weissmann pressed the theory that a criminal conviction for document destruction could stand even when the entity engaging in the destruction had no reason to believe the documents would ever be used in a criminal investigation. He was wrong — 9-0 — but 85,000 people still lost their jobs and a Big Five accounting firm ceased to exist because of his incompetence. Did Weissmann have to go? Well, he went. His LEGAL CAREER should have ended after that — not just his DOJ career. But, as I noted, Mueller saved him. Don’t ask me why.

What an absolute GIFT. I get to spend all day on Sunday explaining why Andrew Weissman is a duplicitous moron, why he was reversed 9-0 by the Supreme Court, and why his criticisms of the SPLC indictment make my case for me. The more people rely on him for ANYTHING the more disconnected from reality they appear.

Zero problem in principle with asking the president about specific quotes and citing them to a “manifesto.” It’s extremely bad judgment right now given what we know about media contagion. So easy to ask the question without giving more airtime to a wannabe assassin and his words.

Hello from backstage. We’re in a hold behind the stage right now. Staff are going out to reset the head table.  POTUS never left and is down the hall from me. He wants the show to go on.  We’re told by his detail someone tried to get through the mags with a gun. The counter assault team did their job (unclear what that means) and the subject is now offsite. POTUS was evacuated to a hold - the rest of us from the head table are down the hall from him. Secret service had to determine if there were any other threats, we are being told there are no threats.  The building is NOT being evacuated. We are waiting for staff to reset head table to resume the program.

As my cancer treatment end grows nearer, I am being more reflective about the past four years. My cancer journey has not been God’s teaching moment for me though I have been totally transformed. It’s really not about me at all. When the CT scan showed me that my abdomen was so full of cancer that my intestines were pushed all the way over to the right side of my body, I prayed that He would use my illness for His glory somehow and someway, and that He would carry me through the whole experience. He answered in spades and helped keep my mind and spirit where they needed to be during this time. One of the most wonderful things is that I am no longer afraid of cancer, treatment or death. I will not live in fear of cancer reoccurrence. Only God knows the number of my days, and I am more than happy about that. It’s on a need to know basis and I don’t need to know. Besides, though I will wring all goodness I can out of life, where I go after this life and Who will greet me when I get there is the real prize - not this life. Warning: I may have more stream of consciousness posts coming during the next few weeks. You’ll have to forgive me.

With each of our children's births, I took some time off work. The time off increased with each birth, because my usefulness increased. But I wasn't mostly useful for caring for the baby. I had limited use in caring for my wife after the first 3 days. I was useful in caring for the older kids. The picture below, from 16 years ago today, captures those wonderful times. Mom and Baby needed naps -- and 1-on-1 time. My job was to take the 3.5-year-old and the 1.5-year-old out of the house. These days, walking the woods endlessly with my two oldest, when they were so little, are among my most cherished memories.

A lot of you guys really like the look of this pizza. Let me tell you more about it. Gusta pizza is Napoli style pizza, which is my favorite. The pizza is very thin, but not crispy, you "fold" the piece to hold everything in, and it still drips out everywhere lol Napoli style pizza has this incredible wood-fired fluffy/chewy, salty dough that's the star of the whole show. They add a lot of sauce, which I love, not too much cheese, a leaf of fresh basil, and this one here is called the "Calabrese" which is my favorite, it's spicy salami, and they really pile it on. The high-quality of every ingredient is just incredible. The guy who owns Gusta is from Naples, so he knows what he's doing. When I was in Naples, I had the best pizza of my life... there's nothing like pizza in Napoli. But here in Florence, this place is hands-down my favorite, and God knows I've tried a zillion pizza spots (all good, by the way)... but Gusta has my heart. They don't take reservations, you can't call and place a carry out order. They don't deliver, and there's always a line down the street. You just have get in line, stand there and wait your turn. Trust me, it's worth it.

The family of Celeste Rivas Hernandez released a new photo of her to the media and said they were too devastated to speak publicly after hearing graphic details during D4vd's arraignment. They were also overwhelmed by the chaotic media attention. Her parents issued a new statement through their attorney: "Celeste was a beautiful, strong girl who loved to sing and dance. Every Friday night was movie night and we spent wonderful times together." More details to follow @LAmag
