Either way, there's likely no chance he'd see a judgment for $5m, even if he were to win at trial.

The lawsuit is not a 5 million dollar lawsuit...
That there is potential for upward of 5 million dollars in damages, does not mean that it is a 5 million dollar lawsuit... Tati is not suing for 5 million dollar.
